received settlement offer today

    This is where it gets most interesting. If they intended to honor their agreement in the first place, sure they will accept it. It means no additional work on their part other that what they intended to do.

    If they don't accept it, then it becomes obvious they were trying to screw you in the first place.

    I really think an RE is your best bet. It WILL flush out their true intensions. Be sure to send a copy of this letter along with it.

    BTW - once they have money they rarely send it back. lol

    Edit: After reading the rest of the posts I see where you've just faxed them. I would have stuffed a Money Order in their face as leverage, but this should work ok.

    good news, they signed my letter and faxed it back to me. looks like the place is on the up-and-up.

    thanks for all the helpful info.

    the letter I sent says that they will consider the account paid in full, it says they will not sell it nor try to collect on the remaining balance.
    it also states they will make sure to delete within 15 days of receiving payment, along with listing both account numbers, etc ,etc

    everything I wanted...

    That is outstanding!

    Congratulations! Looks like all of your hard work paid off.

    It's so nice to hear of one who's on the up and up. Once it's all over and done if you haven't already, you might want to post who they are...maybe it could help someone else.
