I lived in a bad area, so my son attended a private elementary school for K-2nd grade. I moved 3.5 years ago, and he's been in public school since. Received a threatening letter from an out-of-state attorney June 24th regarding an outstanding balance of $1,785. This is half of the years tuition. I have proof that I paid the other half, and my 2001 divorce records, which I believed required my ex-husband to pay half of all education expenses. However, when I read through more carefully, it states that he is required to pay half of all medical & childcare expenses, but doesn't specifically state "educational" expenses. I spoke to the attorney on the phone and told him that I had proof that I only owe half, and that I've paid my half. He requested that I fax him the proof. I was getting ready to send him what I have, but I thought I'd post my situation on here first to see if anyone has advice. I cleaned up my credit very well within the last 6-8 mos and am in the process of buying a house right now...I've got to avoid this judgement. ~MammaJ
I would get a good lawyer to quickly take a look at the divorce documents first and confirm what your ex was really required to pay. I don't know if "childcare" expenses only includes things like daycare, and not school. It would seem to me that you should both split educational expenses, but I'm not a lawyer and I don't know enough of the specifics concerning your divorce. This law firm doesn't have a judgement against you yet, and it sounds like they're far from it, so you should still have enough time to figure this all out and hopefully provide the necessary proof to show that you paid what you owed and they need to start bugging your ex instead of you.
As I mentioned in another post, creditors are not bound by divorce decrees. If you signed for the debt you will be held responsible for it. What the divorce decree allows you to do is sue your ex for his share of it. But I agree with Joshua, you should consult an attorney to find out for sure what the status is.
