I sent a Valadation Letter to RMA On accounts that were 6+ yrs old The same day I got the Green Card back I also got a letter with a actual bill from the hospital and then a Print out From RMA (it was a collection for multiable accounts) with the accounts . In this letter it states they will hold off collection for 10 days until payment is received in full.....Now when i sent the valadation letter to them it had this (at the bottom of this post is the letter) on the letter.. But I never got All of the stuff all i got was 1 copy of a bill(no sig on it just a copy) on 1 of the 4 accounts the rest were just a print out...... These accounts are from Wyoming and I am living in Missouri Is this a legit "Valadation"?? What can i do ?Do i wait the 30 days out and see if they send more stuff or what?? According to there letter they sent this WAS there valadation because they are only giving me 10 days to pay This is what i was supposed to get back but never did......... I have read all the Wollman stuff I have read all the credit laws etc.......But basically what i was asking is should I contact them again and tell them ." You have not furnished any authorization or assignment from the original creditor to allow your continued collection activity on this account. Since I am in receipt of direct communication from the original creditor,and since they make no reference to your company, I am turning over all records and correspondence with your company to the frauds division of the FTC and my State's Attorney General's office.Any further claim or contact from your company will be grounds for my filing a civil suit against you for violations of the FDCPA and the Statutes of Fraud." If Yes should I wait the full 30 days that i stated in my letter to them Or did they VOID that when they sent me there "So called proof"
If all you received was a printout then that is not proper validation. If it's medical what I did was request a copy of the submittal form to the insurance carrier (because I had insurance but the Dr. didn't take it.) A copy of your signature on the hospital paperwork or the DR's paperwork. They did not have this. After I sent the validation they sent me a printout. I proceeded with the Estoppel letter. Then I proceeded with the intent to file suit letter. Then they deleted. They never updated as in dispute either. I hope this helps.
Jeanyjo, If they DID NOTgive you something with your husbands signature on it then they haven't got a leg to stand on!!! All they are doing is bluffing you into paying and they're hoping you fall for it. Call they're bluff and send the estoppel letter (better yet fax it to them) It may take three progressivly harsher letters from you but they will not go to court over this and they will eventually delete it.
