I have this question. I live in a one party consent state. I plan on calling Sleezeball Collection agency which based on their records, are also in a one party consent state. Am I right, then in assuming that I would not be breaking federal law by my consenting to record the conversation? I would rather trick the sleezeball into commiting more incriminating acts before I threaten to sue since he's already violated 2 parts of section 804 in the FDCPA. This question would be moot, however, if I dial up their 800 number, and in the recording before I put in the guy's extension I hear that this phone conversation may be recorded . . . . because at that they're consenting to have it recorded it no matter what state it is in.
