Red Flag, please help!

    I'm going to scream....just when I think I've got a handle on things.........

    Just finished writing a "you were sold a bogus debt" letter. The alleged debt shows on my reports in duplicate by two seperate CA's (I've had no luck deleting them, CA#1 states disputed, CA#2 changed to paid in full).

    I just recieved a new collection letter from CA#3 for this same debt (not yet on reports), currently disputed/frozen with the two other agencies. So I wrote the "bogus debt" letter.

    Just checked for licensure in Florida. They list their mailing adress on that site as next door to one of the other collection agencies in Minnesota! But I can find no DBA's for this one, no other links to the CA#1 at all! What is this? I know the CA#1 has another name as it sometime shows up on my reports, but for all intents and purposes, CA#3 appears to be a seperate entity. Do I proceed with this letter? The mailing address I was given, and that is listed with the BBB is in Florida.

    Hi Butch! (Been meaning to reply to you from another thread.......anyway...belated welcome back! Thought of you while you were here!)

    Background....I don't think so. Let me try.

    I disputed with the CRA's when the greencards were signed for by CA#1 and CA#2, both on November 21st.

    CA#1 has a DOLA of 02/2000
    CA#2 has a DOLA of 07/1999 Both of these dates are fabricated.

    CA#1 lists original amount $1,773 Balance: $2,356
    CA#2 lists original amount $1,773 Balance: $1,773
    CA#3 lists Balance: $3,122

    CA#1 has updated CRA's to "consumer disputes".
    CA#2 has been changed to "Paid as agreed/Paid in full"
    CA#3's collection letter is dated December 22nd, the day after 30 days is up with CRA dispute of CA's #1 & #2.

    Looks like the OC still owns it. When these kinds of situations happen, 2-3 CA's involved, I like the idea of going straight back to the OC, and telling them; "Look, your CA's have this thing so screwed up it's beyond recognition".

    As part of any agreement you might reach with the OC would be that they pull the TL from all CA's as "Reported In Error".

    This triggers an automatic deletion.

    The amount is high enough so that they may be inclined to try and sue for it.


    Are you still within the SOL? What kind of account is this? Open or Closed?

    Lot of things to talk about before we can come up with a strategy. Need to know more than just what's on your reports.

    Not the personal stuff but the more we know the more we can help.

    Okay, I didn't think that it might still be with the OC, there is no OC tradeline, which was Citibank. This is a closed account. Neither of the DOLA dates I see are near correct. Actual DOLA should be 1997, therefor past SOL.

    It's already 04. So depending on what month in 97 you're talking about, it's soon to fall off anyway. Can you pin down the TRUE DLA?

    Look on Exp. and see if you see a line that says: "scheduled to remain until", and a date.



    Can the OC delete CA tradelines? I thought they could not.

    No, but if the OC "withdraws" the account, or "retracts" the account, as "Submitted In Error", that means it should NOT have been submitted in the first place.

    In other words, once the OC states the whole thing was a big mistake all the other ramifications go with it automatically, like posting to your CR.



    I'm still thinking I should send the "bad debt" letter to CA#3, as they appear to be on their own, and the other CA's never attempted to validate. What do you think?

    If we can determine it's gonna fall off soon anyway, I'd work around it. Suppose for example, it's scheduled to drop in April. Well heck you have 3 or 4 more months worth of other things to do anyway. So - right about the time you get all this "other" stuff done this one falls off anyway. Thus, it may not be worth fighting.

    Good Morning Butch! Yes, I know about transferred/sold, and SHOULD show zero balances for CO's. However......... there is NO OC tradeline for this account. That may have fallen off already. I had never seen my reports until the end of October, hence my presense here now. Citibank is not on any of my CR's at all. Only 2 of the 3 collection agencies are on the CR's. These have the fabricated DOLA's, I'm assuming re-aged. I have no idea how to get the actual DOLA. I have no records of this account. Any ideas? NuB
