I have been reduced to tears today. In late April I sent intent to file complaint letter to TU regarding my FMC and RNB accounts, the 15 deadline is this Tuesday but I had a little down time at work and pulled my TU to view progress. I was disputing the re-inserting of an incorrect history on the FMC account and the re-aging on the RNB account.

Results: FMC Status as of 5/02: 60 days past due. In prior 48 months from date verified 1 time 60 day, 1 times 30 days. Maximum delinquency of 60 days occurred in 5/2002. WTF!! I was disputing 9 times 30 1 times 60 days. I had them delete that history last year, but in February 02 it came back hence the intent to file complaint letter. My score did a death spiral from 643 to 519 due to this.

Now I know that this status data did not come from FMC, as they don't have my balance correct, it's two payments behind. After I saw TU I pulled EXP and EQ and they both show the correct balance and I have an online statement with the current date showing the current balance. I don't know what to do besides cry. I honestly believe it is TU not FMC because it is reporting correctly on the other two CR. Someone please help me.

As for the RNB account I can't believe my eyes, they did correct their re-aging. The account was listed as closed 4/00. Status as of 4/2000 payment after C/O~collection. Now it is correct, closed 12/1997 and the status listed as 12/97. I got my sentence reduced by three years.

    Any help would be appreciated.

    D,

are you prepared to go to court over this? because it seem like with tu, you may have to. Have you talked to anybody there? I would seriously be prepared to do the full court press and file on them, indicating that the recent action demonstrates "willful noncompliance" and seeking monetary damages.

    Hey UD

That's what I told my DH. I am ready to sue. I can't take this anymore. Now, I have not received the "official" reply to my intent to file letter. This is me just going online and looking for myself. The fifteen days deadline is Tuesday, May 14. Should I wait till I get that response back? As in "see this is what they sent me" kinda documentation.

Can I sue for mental distress? I needed a Prozac this morning when I saw that score. I had to go into the ladies room to compose myself and stop myself from crying out loud. I am so ready to sue.

file it tomorrow, that is the deadline. then send them another letter, with an offer to settle and a copy of the lawsuit. maybe get an affadavit from a co-worker as to your mental distress upon receiving yet another incorrect credit report and score. will it help ??? i don't know, but i don't see how it could hurt.

I'm having similar problems with ridiculous TU. I have a BofA that was sold/transferred in '97. Both EX and EQ report it correctly as a $0 balance. Only TU seems to "verify" that the balance is $799.

Also, the same deal w/ RNB. They report paid charge off in 2/2000 and it was really from '97. Can't get anywhere with changing that one, and on my EX it keeps updating every month to charge off of the current month/year. But it still says it is only scheduled to stay on record till 10/2002. Don't ask me..... It seems suing is the only way to get them to do their jobs.

I had TU reports dating back form10/2000 showing the true charge off date of 12/1997. So if they were saying that the CO date was 4/00 how could I have a TU dated 10/6/2000 showing 12/1997. If it went to court they would lose and they knew it. I was going for deletion but I take the three years off, I plan to lay low the remainder of this year and hit em up next year for a early delete. I have bigger problems with my FMC to worry about.
