I hope someone can help me with this one: I have an old reposession on my CR that is due to fall off in May 06. I have been unable to get the repossesion documentation from either the original creditor OR the numerous collection agencies that the debt was sold to. The address listed for the present owner of the debt is invalid (came back twice). So I sent a letter to Equifax requesting that they remove the repo since no one can show me any documentation or validation. They sent me the generic 'it will automatically be deleted seven years from date of last activity'. If no one can provide documentation pertaining to the validity of this debt, shouldn't EQ be removing it? I am planning on getting a new car in August, I'd like to lease and I know that with the repo on it, even as old as it is, this may be an issue with my auto score. Any ideas???
In my opinion I would send another letter to the CRA via CMRRR (make sure you put that same tracking # on your letter) and request two things. 1) request the CRA to provide the name , address, and phone # for the party who is verifying or reporting the TL as you have been unable to obtain verification yourself on this disputed account. 2) if they can not provide the actual verifier then they have no means to verify the TL themselfs and must delete under the FCRA. they can not state it will remain until the 7 year reporting period ends. if this doesn't resolve your problem save the responses for future action ( violations) you have to be careful of the Statue of limitations before pursuing this matter as this may leave you open to a lawsuit and judgment. which will only complicate the matter. good luck hope this helps.
