Reinsertion! Experts!!

    Just pulled credit report and there are a whole bunch of paid collection accounts on my report that were deleted months ago. I NEVER got a letter stating they were going to be reinserted on my report. There is even a collection listing on my report that I have a letter from the collection agency saying they could not verify it and that they were going to remove it. Who do I go after on that one, the collection agency? On the others do I just go after the CRA? I also sent a cease and desist letter to this collection agency on all of these accounts. Since the FTC considers reporting a communication can I sue for all these violations? I am so mad I could scream!!!!!

    Why were they deleted? Was it during a Sec. 611 dispute with the CRA? I

    C & D under 805 of the FDCPA does NOT stop a CA from reporting to the CRAs...it only stops them from communicating with "the consumer"

    Same here!

    I have a reinsertion that was removed last year on both experien and Transunion. It has reappared on Experien - same acct. no. and everything!

    I swear I saw a FCRA 'fact' that said that I had to be notified "within five days" that this was happening. Didn't happen.

    Experien is claiming "oh this is a NEW acct. no" - when, no, it isn't and I have last year's report to prove it!

    So far getting the runaround and now, original creditor seems to think that they can verify it. I wasn't aware they got a second chance to wait a year to validate "within 30 days." Is this legal?

    It's as if old debts/errors can just lurk out there and continue to pop up forever?

    See section 611(a)5B about reinsertion. Not only do they have to notify you within 5 days of reinserting the information, they also have to have a Certification of accuracy of information, certifying that the information being reinserted is complete and accurate. From what I have heard, there has been very few cases where a CRA can provide this documentation.
