Good Afternoon I just got off the phone with Equifax regarding a reinsertion of an account that was deleted in May of 2002. They told me that Equifax DID NOT have to notify me within 5 days because the original creditor (Citibank) was responsible - not equifax. It's been almost a year. The tradeline still has not been updated. Please advise me as to what my next step should be. Thank you in advance.
They, as usual, are feeding the b.s. Read section 611 of the FCRA. In short, yes they must notify within 5 days of reinsertion. They also are supposed to have "certification" from the creditor that the info is accurate. I guarantee you they have no certification. Ask to have the cert. sent to you. They also are to have a procedure in place to prevent the reinsertion of previously deleted accts. In short, they screwed up. Send an email to Lanette.Fullwood@equifax.com She will be able to help you. Be nice, as she is a nice lady and very helpful.
Try this letter.... To Whom it May Concern, RE: It has come to my attention, through recent and past credit reports, that you have allowed information to be reinserted into my credit file that has been previously deleted. Pursuant to the FCRA, I'd like to be provided with copies of the certification required for reinsertion for the following accounts: Creditor I will allow you 15 days to furnish this information, however if you do not provide the information requested, you must delete and "cloak" the accounts as required by the FCRA Sincerely
Thank you both. I just wanted to make sure I wasn't missing anything. I will email Lynette now and I promise to be nice. I appreciate all of your help! Slowyne
slowyne: Can you please post back to this thread what happens, if possible ? I got several deletions in last month or so and will be keenly interested in your outcome in case it happens to me. Thanks, Kenn
I'm not really sure how this happened...but here are my results....BTW..YOU GUYS ARE WONDERFUL!! THANK YOU AGAIN!!!! Due to the length of your credit history, you had an additional file in our system. The account was not re-inserted, it was reported on the additional file. We have since reduced your file into one and the account has been deleted. A revised copy is being mailed to you today. Thank you for allowing Equifax the opportunity to assist you. ----
Hmmm... Thanks for the feedback Slowyne. I had an identical thing happen to me with TU. They sent back investigation results which said they deleted two tradelines and there the 2 were big and bold right on the "updated" report. I got the same explanation from TU and they put it back under "investigation", took almost the whole 30 days to "re-delete" them ! Crrreeeepy ! I hadn't even yet started to bang away at PG and WK yet (which supposedly can cause a TU file split) !
Hey LKH - I have to deal with the wonderful affiliate, CSC for my EQ reports. Can I get any help with a reinsertion problem using this same information? I promise to be very nice too Thanks
I'm not LKH, but you and I are in the same miserable CSC boat, you are going to have to send it to them.
Ok, not to hijack here, but I have read and read about split files-and know this is not a good thing. I use PG...we are buying a truck in Sept. and I know they check TU...do I need stop using PG or is it just a freak occurence when it happens? What exactly causes a split file? I know, my last corrected TU report I received had the "special message of many pulls in the last so many weeks" is that a warning I am working on splitting my file?
Does a 30 day late that was deleted and now just returned after over a year count as a re-insertion? Or is it only for deleted tradelines?
Re: Re: Reinsertion Question- Please Advise It counts IMHO (i) Certification of accuracy of information. If any information is deleted from a consumer's file pursuant to subparagraph (A), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate.
Re: Re: Reinsertion Question- Please Advise Slowyne, Be sure to see this thread. http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&postid=335146#post335146
I've noticed through my own recent experience that getting a credit bureau to "reinsert" can be a real challenge ... They will most always stick to their guns & feed you the line ... "We (the CB) only report what the creditors tell us to report." That being said, it's often overlooked & often less hassle to contact the creditor responsible for the original loan you want back in your credit history... I recently tried reinsertion with all 3 CB's and was shot down, but once I contacted the loan dept. of the bank that once owned the loan ... I had no problem getting them to reinsert ... All I had to do was fax them proof of the original, paid loan doc ... W/in three weeks 2 auto loans were back on all three bureau reports!!! I'm no expert (yet) but in some situations it's a waste of time & energy strictly arguing w/the CB's ... Try going through the original loan holder as well & bug 'em until they reinsert. If the loan isn't more then 7-10 yld & you can send them some proof ... they should have no problem reinserting ... just don't take "no" for an answer. (After all, they likely made money off of your loan & if they want your future business it would be in their best interest to accommodate you!)
