Does anyone have any letters that have worked to remove a discharged bankruptcy early? Our chapter 13 is due to fall off this October, but if I could help it along that would be great. Thanks!
I always thought you had to wait the 10 years, but if there is an answer to this I would also like to know.
Dispute it as obsolete and on the basis the case numbers/dates are inaccurate. In my opinion, BK's are very difficult to remove insofar as Lexis-Nexis typically verifies everything.
i've seen several chpt 13's on for 10 years...if you dispute i doubt it would do any good...it's a valid public record
bankrupcty isnt that hard to get off. Basically all u have to do is get a lawyer to remove the file at the courthouse for about 30days... so when they go to verify it.. it wont be there.. so they will remove it
I have heard, first remove the addresses associated with the bankruptcy, then dispute the bankruptcy and they won't be able to verify it without the address. However, it might be more time and energy than it's worth. As a mortgage lender, I've frequently gotten solid approvals even when there's a bankruptcy in the past, as long as credit since the BK is good. Of course, if mortgage isn't your objective in your credit cleanup, other types of lenders might penalize you more for the BK.
Latest opinion I heard on public records and Lexis duties as a data furnisher are this: Since the record is in the public domain,they are only providing a service by reporting it and are not responsible for the accuracy of the record one of their researchers copied at courthouse and sent in.
