Thank you for having this website. I'm new to this and need help. I was sued for delinquent condo fees. While waiting for the court date the attorney's office and myself created a legal payment schedule and settled the matter. I believe we came to this agreement right before or after the court date and they told me I didn't need to show up, so I didn't. I'm not sure when they filed our judgement with the court. I now have a public record on my credit report. The attorney's office is very nice and said they didn't report anything. They also said they would provide me with anything I need to get it removed. My question is, what do I need to do and in what order? Should I send a letter to the credit agencies requesting proof? Should I send letters to the credit agencies telling them it was settled out of court and to remove it? I should be able to get proof of that if I don't already have it. Is settling out of court a reasonable reason for the credit agency to remove it. I thank anyone for their help. Sincerely, KnM
I don't believe the attorney's office. If they didn't file judgment, then who did? Go back to your credit report, or get a updated credit report and determine who sued you. If it was someone other then the attorneys you might want to get whatever information the law office has on their letterhead and send to it to them. If it shows it was the law office, then get their letter and then take it to the court house and show it was paid. The court house will give you a document (satisfaction piece) and then send this document along with a letter to which ever credit bureaus were reporting the judgment.
Thank you so much for this information. It was the lawfirm who sued me, but they are working with me. Thanks again.
they told you that you didn't need to show up..... did you verify that with the court? Did you ensure that the matter was dismissed? Be sure that they didn't get a default judgment against you for not showing up! If they did give you an agreement in writing and it states that you didn't need to show up, great! Check that case number with the court and look for a dismissal or a judgment against you. Good luck. If they did strike that agreement with you and it is dated, you may have a shot at suing the attorneys for obtaining a default judgment against you after settling with you.
