I was wondering if anyone has had any luck removing a bankruptcy? If so, how did you dispute it and what about the accounts that were included in the BK? It's been 3 1/2 yrs now.
Sure, lots of people have been successful getting rid of bankruptcies. It's mostly done by just disputing the banruptcy over and over again every few months making sure yoiu dispute just aoubt the 1st of December and again about the 1st of August when summer vacatons are in full swing. That's just about the only way yoiu can do it that I know of. You can't use debt repair methods toget rid of it because nobody is trying to collect anything from you, so you have to resort to the old credit repair methods which is simply to spam them to death. Just keep on disputing with the credit bureaus methods hoping the bankruptcy will drop off before it drops dead at the end of the 10 year period. There is some attorney advertising on the internet saying he can make them go away by finding legal errors in the bankruptcy filings too. I've seen something about him somewhere, but for the life of me, I can't remember where. Lots of luck.
I had one removed because TU listed that there were $0 assets and $0 in liabilities. I said that this was factually impossible. In addition, they used a generic court name of FEDERAL DISTRICT--they could not verify--it as they had no court listed to go to. The PAID date they listed was incorrect. Also, try pulling your record from the Federal Archives. My bankruptcy was 9 years old, and they called me to say that they could not locate it, and when they called the appropriate bankruptcy court, there WAS NO RECORD OF A BANKRUPTCY UNDER MY NAME. Paper gets lost easily--this may also work in your favor.
Hey, After looking at my TU report my bankruptcy shows the same thing!! Federal district assets $0 Liabs $0 but the entered and paid dates are correct they are listed as month/year How should I try and dispute this, as excuse? Where do I look to try and find the records myself?
So, accordingly, TU will not be able to verify your case because first of all they did not list a specific ct. i.e., U. S. Bankruptcy Court for the Western District of Credit Bureau (so where would they start searching?) Secondly--how could there be a bankruptcy case if there are no liabilities. My TU report had 4 zeros in front of the docket number. One woman I know had her bankruptcy removed after 2 YEARS. She says the day they post the information on your report it is outdated. She got hers off on incorrect liability amount.
Call the bankruptcy court that you filed your case at and get the necessary info. (they may send you a form) to pull your report from the National Archives. Dispute the accuracy--how could you check to verify the info. if there is no court listed--Federal District Court where? How can there be a bankruptcy with no liabilities? Request that they verify this info. It worked for me and I hope that it works for you. In my disputes, I always keep in mind that they must remove inaccurate, obsolete and erroneous infomation. It is obvious that TU does not provide accurate public records information.
So should I write them a letter stating the item is inaccurate and needs to be updated or deleted? Do I state the amounts are incorrect? Also on my other reports in states all the correct info (what court, amount and so on) but the case number is only listed as 7 numbers. Looking at the bankruptcy records the case number is 10 numbers. They have left the last 3 numbers off, does this make any difference??
should I request the report pulled from the archives before I request TU to verify the info? What does pulling the report from the archives actually do and do I need a reason to do it?

If the case number is shorter than it should be, then I consider it inaccurate. It does not matter when you contact the National Archives--I have read some tactics that say that if you request a certified copy, then it is inaccessible to the CRAs. I don't know if this is true. I mailed my form to the National Archives and heard from them within a week. You may find that they cannot locate your files at all.
How do CRA's "verify" BK's? By looking at your report, calling one of the lenders listed there who reported an account "included in BK", and get the lender's "verification" that the account was indeed included. They figure, if a lender verifies it, then the main BK entry must be correct, too. That is why you should see if you can first find a reason to dispute accounts that are marked "included in BK". If you can have those removed, then the CRA would have a harder time verifying the main BK entry. Saar
You can find out whether or not they can physically locate your file. Information put into computers can be entered incorrectly. How do you verify that info.? With the hard copy of the document. That is the angle that I am going to take with Equifax to have my b'ruptcy deleted. Just because there is information in a computer, that does not make it the correct information. In 9 years, info. could have been deleted, changed, etc.
My b'ruptcy is so old that all 'included in bankruptcy' notations have dropped. Someone I know had those removed saying that it was an unecessary duplication of the information contained in the public record on the bankruptcy in their credit report.

Looking at ALL of our bankruptcy records it is showing our street name spelled incorrectly on all of them. On EQ- all info correct but the case number is missing the last 3 numbers it does not specify what division(the court) it just says middle district of XX On EX- all info correct except the complete address to the court is wrong and the last 3 numbers of the case are different. They are the judges initials. Do I have chance at disputing all as inaccurate?? Any other suggestions? One more..... ) My spouse had an at&t universal mastercard.I don't ever remember being an authorized user or on the account at all but anyway it was included in the BK. At the time the account was opened I was under 18.This account is being reported on my credit report as a joint account.A few years ago we tried to dispute it with the creditor-stating I could not have been on the account because I was under 18 etc.. but they would not remove it so after awhile we gave up. On my EX report it states under notices - your date of birth indicates that credit may have been established before age 18 Based on that shouldn't I be able to have it removed? Try disputing as "I never had a baknkruptcy with $0 liabilities or $0 assets." That has worked for a couple of other posters to remove their bankruptcies. Good Luck.
I recently disputed with TU a Bk 13 filing showing up on my husbands file that actually is not his. Reads Federal Court, $0 assest $0 liabilities & a docket number. They sent him a letter saying they have verified this as accurate. Gave him a number & address (no name) of how they verified this info. So I called the number & got the lady's name & all the bk info using the docket number they list on the CR. What part of verification did they actually use? I have just tried to dispute it via the online service. Let's see if they can do a better job. Not holding my breath! Becky
