Posted this on artofcredit.com as well My wife and I have been successful dodging a CA for my wifes repo in 2001 until now. She owes $11500. She just recevied a notice in the mail from the CA requesting payment. I know this is not the first attempt from them, I would just throw out the previous notices (before I found this site). I need some advice on what to do. In Florida the SOL for contracts is 5 years, we are not even close to that. They now have our current address. Not sure how to proceed. They are still using her maiden name (got married 2 years ago) so I dont if that can help. I am weary about sending off a validation letter cause that would confirm that we live there. The CA is Troon Company LLC and they purchased the debt from Mitsubishi. From what I can tell they are not licensed or bonded in Florida to collect. I know that that should end it right there but, should I just ignore this letter, and if they sue then bring up the fact that they are not licensed or should I hit them with it now and chance them selling it off to someone else. I dont care about getting violations or money from them, I just want to dodge this debt until the SOL is up before I get aggresive with this one. Any thoughts? In many states a repo terminates the written contract and any deficiency claim must be filed within 2 years. Check your state repo laws.
