Repo / Charge off back in Dec 2000

    Back in Dec 2000, I had to move to New York from North Carolina due to some family problems. I couldn't keep the payments up on my car so I voluntarily gave back my car. Needless to say now I have a repo on my credit history.

    The car company sold the car again and made the money I owed them. However they posting on my credit that I still owe them over $5000. They already got their money & I feel I have already paid for this mistake, anyways I want to get this taken care of.

    I took the loan out on the car in Jan 1998. I am currently living in NY now. However the loan was taken out in NC. SoL for written contracts is 3 years in NC. Well this brings me to my question:

    Should I dispute with them asking for a VoD or make the dispute with the Credit Bureaus?

    Also if I dispute them can they take me to court?

    I am going to dispute them with the credit bureaus tomorrow after work.... whats the worst that can happen?

    The CRA will report that the item remains, and if you try disputing again, they will call your disputes frivolous and refuse to investigate them any more

    Did you purchase the car in NC and then move to NY?

    If so, this is too easy.

    Dispute the NC address as not mine.

    After it is off your credit report, dispute the repo as not mine. They have nothing to match it up with. It worked like a charm for me....
