Greetings! I'm new to this forum. A very long story made shorter. My husband's ex-wife kept up the payments after the divorce on a car in which he was a co-buyer. Then she files bk in 2000, she nor her attorney notified Steve (my husband) that she included this car ( sickening). Two years later Coastal Credit LLC, (Virginia Beach, Va.)the OC is demanding in letter form that Steve owes $11K on a car they repossessed & sold only for $2K. at auction. I handled it for him by asking for validation letter & their receipts are poor / vague. The SOL was up 2003--so I see now on his credit report they charged-off on 4/03/2003. In June they threatened in letter form ( no calls from them upon my request) they would sue him by June 6th. I wrote before that date telling them they never complied with the Pa. REPO laws to notify him properly. We haven't heard anything lately. My question is can the original creditor charge-off and still do the threatening to sue? I thought they need to hand this over to a CA now? Can they come after his new car he co-owns with me now? What if he wants to put this car in his name only later? Can they take that away. P.S. He doesn't have any money to pay this ridiculous amount off. His ex-wife bought the car for $13K & had made 3 yrs of payments on it. FYI they had threatened also to garnish his wages & hire a PA attorney ( Coastal is in VA.). Steve has child support payments for 2 girls ---can't afford to live with any less. Please advise. The SOL is up, the car was included in BK. The SOL is up. Case closed. Edit to add: They're bluffing. Don't pay those sharks a dime.
I read that in Pa the SOL is up after 6 yrs, but another 4 years starts when OC sends it to CA to try & get the money. Please reply -am I misinformed?
I read this information on creditboards.com under a link directed to debt sol.for state of Pa ...along with REPO PA LAWS. Perhaps, I read it wrong. It said, that a OC can sue you still for the funds after a Charge-off. They will do this with either a lawsuit or send it to a CA. So you mean if 6 yrs has passed & charged-off 11K repo debt, they have no further claims?
