I'm not sure how to deal with this issue. If you have an account that is still open, such as a mortgage, but you were late on that mortgage over 7 years ago due to a job loss, can the late payments still be reported on the credit report? I have tried to have this fixed on the credit report, but they won't change this...still reports as having 2 late payments even though it was over 7 years ago. What's the best way to deal with this?
How did you dispute it with the CRAs? Have you tried writing directly to the mortgage company telling them they are still reporting obsolete derogatory information?
No, they can't. The CRA should know better. I wouldn't start with the mortgage company personally, I'd start with the CRA because they are required to mask any information more than 7 years old even if the data furnisher is still reporting the full account's history. I have several student loans that had lates more than seven years ago. Like clockwork, they became positive accounts about a month before the 7-year mark.
I disputed with the CRA and said they were reporting past the 7 year period. On my online credit report it was showing as "Open, current, was 2 times 30 days late" as the current status. So, I disputed this since it was over 7 years ago. They fixed the current status to say "open, current", but they show a payment history down below, which shows the two 30 day late payments. This information should not be showing, right?
Correct. They need to remove anything that is past the 7 year mark. I would write a nice letter telling them that you thought it was handled last time you disputed, yet the reporting is still incorrect. State the obvious, that it is past the seven years and and that you want to know why it is not being removed from your reports. Make sure you keep a paper trail of all your actions in case you need to go after them at a later date.
