I have a friend who is in the process of getting his vehicle repossessed. He has it hidden in a good place and has other cars so as he states...."They won't get it anytime soon!" The repo guy came to his house when he was at work and spoke to his daughter. The man had a tow truck and wanted to know where the car was? The daughter said, she didn't know. He left. This man called my friend at work and stated he was a constable?? but gave him the number for the repossession company, which I looked up as being only that a repo company. He said he would be calling his employer and sending a letter to garnish his wages. I though you could only do that with a court order. To date to loan company did not take him to court and he has not been served yet. He spoke to the loan company and only owing $2600.00 on the vehicle they wanted $699.00 to bring him up to date and stop the repo. I told him if he paid anything to get it in writing first! What strikes me as ironic is that this car was included in his bankruptcy and he was allowed to keep the car as long as he made the payments, but it was clearly listed and included on his bankruptcy. I thought that even if they took the car they could not garnish wages or get a judgement because he could clearly show the court he was relieved of the debt?? Any thoughts or does anyone know the laws in NJ so I could help him? Thanks! Tac
Tac, It depends on if he reaffirmed the debt or not. If he reaffirmed, they can sure come after him with judgments, etc. That's why most lawyers discourage reaffirmimg autos. Just keep current and if something happens and you can't pay then, you walk away.

He's a WHAT??? Buwahahaha. Tell the "constable" that if he's gonna drive all the way over here from Great Britton it's gonna be hell on his windshield wipers. LOL
LOL!!!! Butch, Believe it or not Constables are quite common around here. They are pretty much elected police officers with almost the same powers. What they pretty much do is serve papers and do evictions and pick people up on arrest warrants and such. They are mostly used by the courts but have full arrest powers like a police officer. It does remind you of Great Brittan though! LOL!! Tac
Yep, we still got constables as well. The are pt here and are used by the Sheriff to serve summons in very rural parts of the county and patrol along small "farm to market" roads in little x roads farming communities.
i need help i think i already know the answer to this but i need some extra opinions. my car is late on payments and it was out for repossession, but dont they put that yellow boot on the car n give a last chance to pay. i know they do in ny. but either way they cant just take the car out of your drivway without some sort of notification. right? my mom came home at 8:00am and my car was there. by 8:30am we went out to take it for an oil change and it was gone. there was weird tracks in the driveway and no notification. we called infiniti and they told us they have to leave something usually in the door or the mail box. but there was nothing. my dead beat step dad who lives in ny is the only one with the spare key. he stole the key from our house. he pretty much had someone take the car or he stole it himself? right?
