I requested that a CA validate a debt 6 years ago, I just received their validation information. What can I do? I know the SOL has passed, but can they do anything at this point.
Yes, they can still file a lawsuit against you and if you fail to respond correctly they can get a judgment regardless of whether the SOL is out on them or not. If I were in your shoes I'd just tell them that I refuse to pay but since you don't know how to make that little trick work for you then I'd just suggest that you send them a full cease & desist letter and see what happens from there. Like this. Dear scumbag collection agency: Please be advised that I demand that you cease & desist from any further contact with me by any means whatever from now on. ____________________ Outraged consumer. 1234 anystreeet State of confusion, 99999 Phone 1-800-328-7448 By the way, the alpha translation of those numbers are sometimes seen on the tailgates of pickups and other trucks. I'm sure you have seen the sign that says if you don't like the way I'm driving call the above number. While that may be a bit funny, I'd advise using your own phone number instead of the one I gave you. Then if they ever call you can sue them for having violated your cease & desist. Just be sure you will have no trouble proving the SOL to a judge if need be. Cancelled checks and that sort of thing. If you have to go to court you will have to prove when you made your last payment to the original creditor. On the other hand, if they provided you with a full documentation as they should have done then you have your proof by their own admission. If you can't prove the date of your last payment then for heavens sakes don't send any cease & desist letters to them. That can easily end up getting you sued and if you can't prove the date of your last payment you will end up with a judgment. So be careful what you do before you do it.
