I sent a dispute letter (asking for validation) to many of my creditors - mostly CB's from accounts that are pretty old. Mainly medical bills. So heres the thing: this one bill in particular was from a radiologist, sent to collections. Had an xray done of my hand when in the ER. Showed up on my CR as a paid collection. So... in response to my letter asking for validation, i get a handwritten response, on the CB's letter head, stating that it was from the radiologist for an xray on such and such date, under ss #xxxxxxx, it was filed to insurance and declined due to the insured not being actually insured (the policy had expired or they had the wrong one???). It included that it had been paid in full on X date, etc. They attached a smalll slip of paper, highlighting the name of the radiology company, the date, and that it was an xray of a hand and it also showed my SS#. Is this proper validation? Now what?! I want this paid collection OFF! HELP! Thanks, Rain...
Did you ask for VERIFICATION or VALIDATION? I'm guessing by CB's you mean Credit Bureaus, which most here refer to as CRA's - Credit Reporting Agencies. If you asked for validation from the CRA then they have no obligation to respond, unless they are acting as the CA. If it is only a CRA then you need to dispute with these folks. But first, if it is a paid collection then do yourself a favor and research the "Nutcase Rationale" as this is designed for paid CA collections. The process as I understand it is: 1) Validate with CA 2) Dispute with CRA 3) Estoppel to CA 4) Dispute #2 with CRA 5) ITS to CA 6) Small claims 7) PR to CRA 8) ITS to CRA Anyone correct me if I'm wrong on the steps here.
Yes it is a Credit bureau, who is basically the collection agency. I have also disputed this with the CRA's, but i am still waiting for a response. Im hoping the ball gets dropped along the way. Ill wait and see what happens at the end of those 30 days. Rain...
If it is the CRA acting as the CA then they have to follow the correct validation procedure. Send your second validation request CRRR and once you have the green card, dispute with the CRA. The hope is that they don't validate, or list the debt as being disputed, both of which are violations.
So is the letter they sent (that i posted the details of in my original post) NOT considered "validation"? I guess Im confused as to what exactly is considered validation on a paid collection for a medical bill. Also, i did send this CRRR, and do have the green card. Send a second validation request? Start here on validation as this will provide you with the pertinent information on what a full validation actually provides. You might want to also follow some of the other recent threads on Nutcase and UDF reply to nutcase as these are providing some great guidance on what to do with paid collections. And to correct an earlier mistake, failing to validate is not a violation (thanks for setting me straight Butch) but reporting to the CRA that the debt is not being disputed is a violation. That's why you want to dispute with the CRA after you receive the green card back from the CA so that you are forcing the CA to provide an updated status on the account.
