response from intent to sue- (long)

    okay, the ca calls me and wants to know what the heck is going on.

    ca: i see that you sent letter certified mail and they were signed by our ee's , i don' t understand., Our records show we talked to you in Oct and you said you would pay the debt.

    me: I wanted the debt validated before I would pay. Why would i pay if the debt is not mine.

    ca: well, we can send you a print out

    me: a print out is not considered validation according to the FTC. you have had plenty of time to validate this debt

    ca: are you saying you want a copy of the signed financial responsiblity note

    me: yes

    ca; we don't know if the hospital has that, this account is over two years old and is not in the system

    me: that is what constitutes validation.


    okay, should i have asked for deletion at this point? I did not because i did not want to tip my hand. I sent this letter to ceo of ca so, i am sure that some one got chewed out about this.

    what should be my next step.... i am ready to file suit. one account is probably mine, the other is my son's who was over 18. these are medical collections.

    thanks lizard. I have been fooling around with these folks since Oct and they have not come close to validating. Plus I called the hospital and collection told me that they account is not even stored at the hospital. It took them over a week just to send me their computer printout! I doubt they can validate.

    I will ask for immediate deletion... do you have a template for a final notice letter... i already sent the lizardking intent to sue letter!
