This is NOT a child support post. Rather, I am aware that Ohio is not a community property state. A CA representative just claimed that I am liable for my spouse's medical debts, and that Ohio law reflects as much. Where can I go for affirmal or refutation of this claim. I have searched fruitlessly online for related info for the last 2 hours on and off.
YOU HAD A "JOINT" ACCOUNT ON THESE MEDICAL DEBTS??? I never knew MEDICAL DEBTS could be like a CREDIT CARD have a CO-SIGNER "JOINT" ACCOUNT HOLDER... CRA--->NOT MINE
George: 1. That's the fastest response I've ever seen. 2. Heck no, I didn't sign on this debt, although the wife did use my health insurance.
Re: Re: Responsible for Spousal Debt in OH? although the wife did use my health insurance. That does NOT make you a "JOINT" account holder!!! CRA---->NOT MINE---PLEASE REMOVE
Re: Re: Responsible for Spousal Debt in OH? Oh, they haven't even reported yet. I was just calling to check how much they think we owe.
Tell the CA they are full of $hit. Ohio Revised Code: § 3103.08 Responsibility. Neither husband nor wife, as such, is answerable for the acts of the other.
Could you tell me precisely where you found that, in order that I could read the associated section of Ohio law?
Re: Re: Responsible for Spousal Debt in OH? Go to the State of Ohio web page www.state.oh.us Link to Laws, then scroll down to Domestic Relations Act, click and select the last section.
Re: Re: Re: Responsible for Spousal Debt in OH? Get the CA to put it in writing, otherwise it's just your word against hers.
Re: Re: Re: Responsible for Spousal Debt in OH? Oooh. Good point. Of course this is a national company, so it'll be a pain in their neck to show up in court.
Re: Re: Responsible for Spousal Debt in OH? Be careful: § 3103.03 Support obligations of married persons and of parents of minor child. . . . (C) If a married person neglects to support the person's spouse in accordance with this section, any other person, in good faith, may supply the spouse with necessaries for the support of the spouse and recover the reasonable value of the necessaries supplied from the married person who neglected to support the spouse unless the spouse abandons that person without cause. Depending on the nature of the medical care provided, this section might be interpreted as making you liable.
