ripped off on ebay..smalls claims?

    can I sue someone in smalls claims court for ripping me off on ebay? they guy I bought the crap from is in California, Im in Texas. If anyone knows let me know. Thanks.
    im out $400.00 at the moment :/

    Have you gone through square trade yet. They have a link on the ebay site. I used them a few months ago and had great results.

    there is a cap on ebay disputes, its like $175.00 (if they even decide you were defrauded) which is much less than what I lost. Squaretrade wont do much for me since they guy most likely wont even respond.
    Im just going to try disputing with my credit card company.

    File mail fraud charges. You can also file a claim with paypal if that's what you used.

    I'm sorry you got ripped off. Was the product not delivered or not as you expected? This can make a big difference. If you sue, you'd have to prove that your money was taken and no prduct received or that the seller intentionly misrepresented a product. This is after you find the persons real name and address. I sell (and buy) on Ebay and can tell you that most peoples listed name and address are phony. Some people are phony too. I've had a 95% success rate (estimate) . I've also had people claim they never received the item (3 months later), the perfume bottle was empty ( brand new in cellophane wrap) and one that never payed and was returned back to me from a totally different state than sent to.

    So, your CC company is the best bet. Ebay will NOT help you, they are only after their own money. Give up with them now. You may take a look at the feedback from others to see if there is a history of rip-offs. Will the seller not respond to your complaint? Is it a valid complaint?
