Gooood Morningggggg everybody, I have not posted in a while and I need your input. I received a "Notice of Pendency and Proposed Settlement of Class Action" regarding RMA. seems as though someone is suing them and I can either be apart of the settlement or opt out. Can someone give me insight regarding being apart of a settlement????? I read the Action and it states a claimant could receive up to $200. However, as I read it states "each class member is bound by all determations and judgemnts in this Action concerning the Settlement, whether favorable or unfavorable". This the part which concerns me. I have no knowledge of a settlement at all. Can someone please give me you input???
In general, my advice, if you aren't thinking of sueing them on your own for the same thing, in hopes of getting more $, then stay with the settlement class action. Even a small settlement in a class action suit, is better than nothing, and you don't have to sue for yourself to get the ball rolling... Basically, the clause just means that IF you choose to stay in the settlement class, and the settlement is approved, you just can't try to sue them for the same things on your own... Usually if there is an actual settlement the court approves it unless there is an extrordinary reason for them to not accept it.
Class membership vs. opt out can depend on your net recovery as a class member. It also depends on how good your evidence is. Usually if a group of plaintiffs is certified as a "class", they've passed some fairly stringent tests as to their evidence. If you've been seriously damaged by RMA, then you may wanna check with an attorney and explore your options. Otherwise, you may want to remain part of the class; spend no money on costs and atty's fees and no headaches.
RESULTS are in: I received the settlement check for a whoppppppping $5.82. hahahahahahahahahahahhaha I wonder just how much the actual settlement was and how people it was divided by?????????
That's the one thing about class actions, usually the amount is small... but it's $5 that you didn't have yesterday...
