I have a charged off radio shack credit card that shows as such: RSHK/CBUSA opened 11/89 reported since 3/2004-WHY did they wait 15 yrs to put it on my credit report??!!! Is this legal? charged off 3/2004 Charge off amt is 370.00 and it even shows a payment of 40.00 recently but no date??!! Huh? That is weird as I don't recognize this acct. I have disputed it via Experian as not mine. I have a few questions on this. 1) I have a CHP 7 bankruptcy that discharged in 1992 of which fell off my credit in 2002. I have NO collections, nothing on there but this charge off from radio shack now. I've had perfect credit since 1992 and now this account popped up out of nowhere! I have never received any collection letters, nothing from them or any CA representing them in the past. I have 2 radio shack cards that I did get discharged via the CHP 7 however these account numbers do not match the account number on my report. Nothing close to it...IE: The paperworks shows a 77....acct no and the CR shows a 33....acct no. I have nothing to compare the acct no. on the CR to the CHP 7 paperwork as the 2 accounts were joint and this account on my credit is showing as individual. I have never had an individual Radio Shack acct. and this being from 1989 who knows why they are reporting it. I can't figure it out. Is there someone I can call at Radio Shack for information to figure this out? Anyone have a number I can call? 2) IF this acct comes back verified then what would my next step be? Since the CHP 7 has fallen off my report 2 yrs ago then I definitely don't want to bring up a CHP7. Either it's not my account or it was one included in the CHP 7 because when we filed we included every single card we had. The only thing is the acct on my CR is a weird acct no and doesn't match my bankruptcy paperwork. My husband had a radio shack card (closed on his reports) and on his credit report it isn't anything like the one they are reporting on mine. So how does one get a chargeoff removed when in fact it was included in a chp 7 years ago....without the acct nos. matching??? Plus my last name was different in 92 then now too. Could they have reported a different acct no because they sent it to another area to collect on it? I am so confused.......and I need help/advice. My credit has been perfect since 1992 and everything I have gotten has been alot of hard work and alot of learning and now this thing is showing up. Thanks for any help.
When was the last actual payment... The CO should have been sometime within 6 months of that period. There is no rule as to when a company may start reporting, as long as they are reporting the matter correctly. (And unless you just went into default of this account in March (September 2003 could have been the last payment date) then this isn't being reported correctly) Technically a company could wait until 1 month before the 7 year fall-off period to begin reporting, as long as they correctly report the delinquency date. What it appears happened, is that in this case, they started reporting it again on 3-2004, and that became the CO date. NCO just got to write a $1.5 million check to the Federal Trade Commission for this type of activity. The problem you will run into is that if they do verify, EX will probably never give you another chance at disputing it, unless you can come up with a smoking gun, or find some way to twist their arm to re-investigate it.

I have never made any payments on this and if I did it was WAY before the CHP 7 discharge in 1992....Maybe sometime between 1989 (opening date) and 1992 (discharge date). And how can I go into default when it was opened in 1989 and I never made any payments after 1992....seems like 12 yrs is along time for them to wait to CO an account. My discharge was May 1992....so if you want I will say they waited from 92 to 2004...so say 12 yrs.... They show a 40.00 payment on the report made in 3/2004. I have had no contact with radio shack since my discharge as both accounts were included and written off and off my reports completely. I don't know who made a payment but heck I guess that lowers my balance. It is also showing as individual responsibility and the only 2 cards I had were with my ex husband during the discharge and they were joint. And the account no they report on my CR is not even a radio shack acct no. so I can't compare it to anything. It begins with 33 and my current husbands card beging with 77. I know citibank took over radio shack recently. I'm wondering if they charged the account off when they received it cause radio shack didn't handle it as discharged in my bankrupty. Oh and I did include every card I ever had in 1991 in the bankruptcy when we filed. We're talking many years ago too and I do still have all my paperwork. The thing that makes me mad is they never called or mailed me anything about this situation...just threw it on my credit report. If they would have contacted me I could have cleared it all up and would know what is going on. I'm going to have to write them for VL. The account went delinquent in 3/2004 so this Neg. is legal to report as of 3/2004. Say you took out a home loan in 1989 kept it paid up current with no NEGs but in 3/2004 you were late or the account went delinquent or Neg. They have every legal right to report the Neg. even though the account is 15 years old and well past the 7 year reporting period. You see the recent or current Neg. created a brand new 7 Yr. reporting.
How can I default on a card that was included in a bankruptcy years ago? What gives a creditor the right after 12 yrs to report a payment when none was ever made and then show a CO on my report also after this long? I haven't made ANY payments on this card for the past 12+ years (way before 11/91 when I filed the chp 7). Shouldn't the deliquency be the date of my LAST payment sometime in 1991...not 2 months ago? Isn't there a law stopping creditors from reporting an included in chp 7 account as deliquent years later after the fact? I understand about not paying on an account you currently have but this account was discharged 12 yrs ago in bankruptcy and should NOT pop up again. Now I need to validate it and get proof of this but the only letters I can find are for debt collector validations. If I write them can I just dispute it as included in my bankrupty dated 5/92? Or is that a bad idea? I can't seem to find one for the original creditor only. Is there one that you know of geered towards the original creditor only? I have never had any collection accounts on my reports even while the bankruptcy was going on. I guess I got lucky...as the collection agencies didn't report any way back then and there's none reported now from this account. I don't know if they just didn't send it to collections? But I'm curious what would make a creditor wait 12 yrs and not pursue a debt and then just throw it on my credit report as a CO? Wouldn't they attempt to collect it? Or now that it is charged off they will now sell it to a collection agency and then I'm screwed and have to worry about 2 different things (the original creditor tradeline and then the CA).

CBUSA/Radio Shack,MCduff/CBUSA and Winston Tires/CBUSA are old charge-off account from Hurley State Bank (Now Citibank USA). It was old Charge-off account back in early 90s and they put it back into both of my Equifax and Experian credit report. It showed that the accounts were recently charged off as of April 2004. I sent them my previously TransUnion deleted letter to prove those accounts was deleted. The Experian removed it those accounts within 15 days and the Equifax was tough to remove and they removed Radio shack and Mc Duff. The Winston Tire came back to verify and it stay in the credit report. I resent the Experian account verification letter to Equifax and I received a letter yesterday. They told me that Winston Charge-off account was deleted. It took me three month to dispute all four accounts. Last time, collection agenices put old Bank Of America charge-off credit card account and Fleet Bank closed one of credit card account. By the way, I called BofA credit card customer and I asked them whether they have charge-off or not. I knew that I don't have it any more otherwise I couldn't have two Platinum Visa from them. They told me to write to Credit Reporting Unit in Virignia. They told me they don't have the record. Next thing old BA charge-off account was removed from TU. It is tough to remove old charge-off back ito the credit report. You need paper to proof that it was over 7 yrs old debt and it cannot report again after 7 yrs. Sometimes the collection agencies changed account numbers, date made you to contact for paying old debt. Ron.

You may need to check Equifax credit report and they may report it to them. They reported it to both Equifax and Experian. Ron.
Ron, I did just order all 3 CR's and that was got me mad was that only Experian reported it. I check my reports about every 6 months. Let's hope it doesn't show up on the other 2 but so far it hasn't.
Radio Shack report to Experian after two months they report to Equifax. I'm glad that I have credit monitoring services. They told me that my credit report has been changed and I knew that CBUSA report the charge-off account to my credit reports. Keep the credit bureau vertification letter for future in case they put it back. Ron.
OMG! RSHK/CBUSA just did the same thing to me! This was never my debt and it was a bugger living with it for seven years! I suspect I was a victim of identity theft before it gained popularity. I did not know the depth of it for some time and discovered it when I never received an electric deposit refund only to find out a former roommate cashed it! But that is beside the point, back to this disaster: The account was opened 5/1989. It was on my reports for years with a DOLA of 12/1989. It was originally with Radio Shack/Hurley State Bank. When I went to apply for a mortgage, there it was again, with a charge off date of 12/1998. I then get a settlement offer in the mail 7/1998 which I disputed as per the mortgage advisor. I disputed with credit bureaus too and it came back verified. It is really a shame I did not know my rights then. HOWEVER, I did find the settlement offer letter and the certified mail number is written on there including the day it was sent. BINGO Now it has shown up again with a DOLA of 1/1999, a month after the supposed charge off? They just started reporting again and under status they indicate they are skip-tracing to locate me. I have put together a nice little letter letting them know I am here and outlining all of this to them but now that I see other posters finding the same thing maybe it is time to consider something along the lines of a class action suit. Didn't NCO just go down for this same thing? I have proof of their deception, how far should I go?
