So I have been getting phone calls all the time about some account with BOA. I have told them many times to contact me by mail. The refused to give me the address to send a S&D letter so I had no choice but to continue to tell them. Hoping they would send me something with the address. They never did. Anyway today I got a call again and I repeated what I have been telling them every time they call. The guys says well then you need to send a S&D letter. I said I know but since everyone has refused to give me the damn address there isn't anything I could do! So he gives me the address and tells me it needs to be signed by me AND my attorney. HUH? Since when do I need an attorney to send them this letter? I though I could do all this on my own, at least for the most part. Am I right or is this guy right? Do I need an attorney to sign or not? The guy is wrong. If you have to, pretend to need their address for sending them payment. DON"T PROMISE anything but say something like, "Tell me, how can I send you the money you ask when I don't even have your address". Once you have the address, go to the sample letters on this site and create a letter to them that first asks them to validate the ALLEGED debt and second, tell them that they MUST cease and and all PHONE contact. Inform them that the ONLY contact acceptable is by letter if and ONLY after they validate the debt. Do NOT sign the letter!!!!! Just request the validation and the no phone contact directive. Don't offer anything further, do not give specifics, don't tell them why you disagree with the debt, don't give them your social security number. Proving it is THEIR responsibility - NOT YOURS. So don't help them by being to descriptive.
Just another quick question. Why should I not sign the letter? Do I not even put my name at the end of it? Should I also send it certified so when someone signs for it I will know they got it? Thanks! April
Re: Re: S&D needs to be signed by attorney? Signatures are a bad idea in case they can match it up with anything they may have on file. Putting your name at the end is fine. Always send everything certified mail so you can start a paper trail and know it is one of the most valuable things you can do.

I realize that is a lot to ask but I keep reading and re-reading all this different stuff and keep getting more confused.
