What happened to due process? We live in Dallas, Texas, and a constable visited a relative about our daughter's SUV that was financed by Ford Motor Credit. She got behind in her payments, but later caught them up, except for December's payment. Also, she still owes late charges for Oct-Dec. Ford filed court papers. We spoke with the constable and he said the Judge has ordered him to pick up the car until the court date in two weeks. Since she was unemployed for a long time and needs the car to make it to her new job, we were about to make her a loan for Dec. and the late payments. All of us acknowledge that she was in violation of her contract, but does anyone know if we have any legal alternatives, other than surrending the car?
