Sample C&d Letter

    Where can I find a sample cease and desist letter?

    Thanks, I found the sample letters.

    Can I omit the following statement from the sample letter: "It is my personal policy not to deal with collection agencies and I will only deal with the original creditor of this account. "?

    I don't want to deal with the original creditor either. The account is past the SOL and will expire from my CR shortly.

    Yes. Actually, you should just use those letters as a guide, and make them your own. The CA's and CRA's will take you more seriously if you haven't sent them an obvious form letter!

    I'm trying to keep it simple.

    Can I get by with:

    "I am writing to request that you cease and desist in all efforts in contacting me pertaining to collection acitivities on the account listed above."

    Any help with wording would be appreciated.

    you can customize the letter to better fit your circumstances.

    I'm looking for suggestings to keep it simple and generic.

    I sincerely believe that short and sweet is the best way. I like my letters strongly worded.

    Dear Abnoxious Collection Agent/Original Creditor,

    Please consider this letter formal notice of my desire to not communicate with you in any fashion. I do not have any association with your organization. Please cease and desist all communication, both verbal and written. If you continue to pursue a line of communication, I will have no choice but to exercise my legal rights in a court of law.

    Thank you for your assistance with this matter.

    But, can I say, "Dear Abnoxious Collection Agent/Original Creditor"?

    Kudos to Rblues for the specific yet brief letter idea!
    Mr Alan definitely received many options from the posting suggestions, I hope they help! Here is my NOT so brief letter of C&D<edited for easier viewing>.that added humor yet still meant business:

    "On the advice of counsel, I hereby exert my right to request that you CEASE and DESIST any further communication via:telephone, postal service,email,text messaging, planes, trains, smoke signals, telegraph, cb radios, two way walkie talkies, Morse codes, pigeon carrier, African drums, sign language <with or without an interpreter>,cup and string, séance medium either living or otherwise, pantomime, graffiti ,Braille , snow pee writing, hieroglyphics, or stealing letters fromWheel of fortune! Singing telegram<off tune or not!>, or use of girl scout cookies to lure the consumer ! This is in reference to the account to collect for an â??allegedâ? past debt."
    Whilst this may not seem professional it sure does narrow down there chances to correspond! Take this message as a way to lighten up an otherwise serious matter :)

    You will not receive further notice and any deviation from this lawful notice will be considered a willful violation of the FDCPA which will make you liable to me in the amount of $1,000 should I be compelled to pursue legal action.

    Yes, I've used it successfully -- I can't remember the last CA I talked to. The phone ringing is actually pleasant :).
