I just wanted to mention, according to one of your credit reports, the date of last activity was 4/99. I believe this account might be past the SOL. If this is the case then these aholes are sadly out of luck. The best way for you to call their bluff (yes I am reitterating this) is to make them validate everything. When I say everything I don't just mean the application, I mean the last billing records as well (so you can see the REAL DOL). I really hope you could get ahold of an honest reputable lawyer to help you out here (I realize money is a problem right now though) Also if all else fales you could always file BK then nobody gets anything. Re: Re: SCARED! Summons Served today! Curtis O Barnes (attorney debt collector) is collecting for CCAV (scumbag out of Colorado), who bought a Direct Merchants charge off. I'm validating with attorney, who has to go thru CCAV, who has to go back to DM for proof. Oughta be fun, if I ever hear from them again.
Thanks...they have only stated my husbands name on the summons I received, however it was a joint account as stated on the credit report....Im going to the paralegal at 8:30 tomorrow...anymore advise would be great! Thanks Michelle
ALSO...the date of last activity is 4/99 when it was still owned by fleet and 8/99 for asset...but in the summons it states 7/99. Its shows the charge off as 2/2000. I dont think I have SOL as an issue here...since its 5 years? Am I right?...I am so scared to go to this legal aide thing tomorrow I hope all goes ok.. SOrry, but there was something else I wanted to add, when I was getting all the papers I have ready for tomorrow morning, I noticed that the only letter I ever received from Asset shows the balance being $12941.56 and it only being under my husbands name, when in actualality its under both...
Re: Re: SCARED! Summons Served today! OK...I just got home from legal aide and it was not very fruitful. Apparently according to my paper work, today is my last day to file an answer and they will not help me..they only gave me some paperwork on how to file my own answer and Im on my way down there as soon as I find the right letter to file. I have to deliver this to the Court house myself! I did not realize that husband waited this long to tell me about this, therefore the papers were actually served on 4/11 So my 20 days are up today! So, here I sit trying to figuire out what I need to say and write? Ive looked through all the templets on here and other sites but nothing really fits my situation..if there is ANYONE that is online right now that can help me with this letter, I would SO appreciate it. I need to get this done today ASAP to drive all the way back down town to file this response. I got up enough nerve to call what I was told a "reputable" attorney and spoke with him on the phone, I told him briefly the situation, and basically told me that either I deny the debt or agree to it, and that Collection agencys are pretty accurate and up to date with there info..he was not interested at all in even talking to me..so here I sit, Im going to have to try and do this myself...Any body out there?? I really had no other choice..I cannot afford a lawyer...legalaide could not help me...and the Lawyer I did call did not give me any help whatsoever or enough nerve to call another. I wrote the letter and went back downtown yesterday to file it, I also sent a response to Asset's lawyer and one to them. It looked and sounded pretty good, and I followed all the guidelines I had to go by. Took all of the advise and suggestions I was given and rolled it all into a letter. Went and bought proffesional paper, and envelopes, typed labels etc...looked pretty good and I felt pretty confident. So I will keep everyone posted as to what happens next....Does anyone have any idea how long it will be before I hear back from the court or the Plaintiff's Lawyers? I was advised by the paralegal ( from the information he received from the Attorney HE talked to FOR me) that this is just a summons stating that ASSET is planning on setting a court date to sue me...I thought that what I received was a summons suing me? Was I assuming this was something more than it was? Anyways...again thank you TO ALL for your help, encouragement and expertise...it has helped me through the week! Bless you all! Michelle
