Screwed by CA

    This will be a long post, so please bear with me...

    At the end of June, I checked my credit reports (threat of identity theft) and found only 1 negative entry, from a CA. I had no idea what this was about, so I called them (I hadn't checked any credit forums--I'm 21). After several calls, I found it was for a bill from an ER doctor. I had Medicaid at the time (I'm a student and single mother) and the hospital was at fault. I turned in my card and the paperwork somehow got messed up. I never once received a bill or call from the hospital, OC, or CA. The CA told me that if I paid the bill ($100) in full, they would delete the entry entirely. That thrilled me, b/c the $100 isn't a lot of money. Needless to say, they neglected to do so.

    I sent them a letter requesting they delete the entry, as agreed (certified mail, return receipt) along with letters from the OC (who actually requested the deletion as well w/o admitting fault), Medicaid, and hospital. This is all to show the hospital is at fault and not mine. Well, they called me when I was attending a wake (I only have a cell) to say they would not honor their agreement. I have since reported them to the BBB, FTC, and Attorney General's Office. I contacted an attorney, who sent a demand letter several weeks ago to both the CA and OC (she said the OC is also responsible--how?). BTW, I also have a recorded telephone conversation (legally) where the rep admitted the agreement and they would not follow through.

    Now for my questions:
    1) I am assuming they will not respond to these complaints and demands, so where do I go from here?

    2) The attorney who wrote the second demand letter acknowledges they violated federal laws. However, she will not take it to court if they don't respond. I can't find an attorney because the amount is low. What are my options?



    I don't want to go to small claims b/c as I understand it, the judge can't make them delete the entry. I don't want to go to fed court, b/c I am not an attorney.

    I really NEED some advice! This is the only negative entry on my CR. Please help! All responses, advice, comments are appreciated!
