Sending Sears a non pp letter for several ARs on sold & settled account - have an address of 3333 Beverly Rd, Hoffman Estates, IL 60179. Does anyone have any more specific address info or should I just include "Attn: Legal Dept." and send it on its way (CRRR of course!)? Thanks!
Re: Re: Sears Non PP ~ Address? The ARs are on my TU report from 4/03 & 1/03 (I was wrong about the "several" - that would be Discover) so there are only 2.
Re: Re: Sears Non PP ~ Address? Here is some info: Law Department Sears, Roebuck and Co. 3333 Beverly Road, B5-204A Hoffman Estates, IL 60179 847-286-6022 847-286-5421 (fax) Two Senior Paralegal's: Matthew J. Chamberlain mchamb7@sears.com Di Santinello dsanti2@sears.com I am going through exactly the same thing with them. My account was included in a CH7 close to 3 years ago.
Re: Re: Re: Sears Non PP ~ Address? So they are still pulling - which is what I wanted to know. Send a non-pp notification (instead of a demand for money) to the Hoffman address - didn't specify legal dept. If they keep pulling, this makes it "willfull" as they could no longer plead ignorance. If they stop you still have the 2 so you haven't lost anything. Or just do nothing and wait awhile and rack up more non-pp's so can sue for $more$ + deletion. 0
Re: Re: Re: Re: Sears Non PP ~ Addr Great, thanks for the advice zero! So I will cross my fingers that they will continue w/ their non-pp's - I really want this one deleted! Now, if only RMA would do something stupid I could use for leverage I would be ecstatic!
Re: Re: Re: Re: Re: Sears Non PP ~ Addr 1. If deletion is most important - ie. you need to improve score right away then by all means get started with the legal stuff because Sears will drag things out to the last minute. You should be prepared to have to actually file to get their attn. 2. Has RMA validated? Have they marked your account in dispute? Have they changed any of the dates and/or amounts? Those are all violations. I have a letter from RMA cancelling my account & deleting and a settlement w/ Sears (can't say more because of signed non-disclosure.) I know of several people who have sued Sears over the same thing and I am absolutely dumbfounded that they are still pulling non-pp's. If they fixed just that one problem their cc division would be in the black ;-)
Re: Re: Re: Re: Re: Re: Sears Non P 1. Well, deletion is my primary goal w/ Sears ~ but not necessarily an immediate need. It's pretty old and should come off in about a year, so while it's a neg TL, I've got others that are newer that I think will probably be harder to get rid of and are probably impacting my score more. Right now, I'm sitting at a 639 EQ - need a 641 to get a loan from my bank for home improvements & I'm waiting on a couple of disputes. So I thought I might get to work on the Sears non-pp while I was waiting... And on EQ, they're reporting my curent status as R5 (can't be 120 past due if the account was sold/charged off/settled, right?). But, obviously I want them to delete it, not change it to R9.... It's just a big mess... =) 2. RMA.... I settled w/ them in 12/01... I disputed w/ EQ (only CB they are reporting to) before I found CN, but didn't know what in the h*** I was doing, and disputed the status (09). Rookie mistake. Their dates (DOLA 4/98) are running 6 mos. behind Sears (DOLA 10/97), but haven't changed or re-aged. So, I'm not exactly sure what my next step w/ them will/should be. Any ideas/thoughts/suggestions on these? Yeah, it appears Sears is not a fast learner - it amazes me the number of companies that have financial problems yet continue to do stupid things that they know will cost them money. Then again, if I were a financial whiz, maybe I wouldn't be in this mess! =)
Re: Sears Non PP ~ Addr Zero, I'm working on RMA (the CA) right now, and then I have to deal with Sears (the OC) at some point. I'm interested in anything you may be able to mention about how Sears/RMA might behave to the effect of deleting and settling, without violating your non-disclosure, of course. I sent RMA a validation 1 last week. And I plan to send the CRA a dispute of the RMA account in about a week. I'm hoping RMA cannot validate, and this will get rid of the CA TL from my CR. But then I have to worry about the account bouncing back to Sears, and then perhaps another CA. BUT, from what I understand, Sears pretty much owns RMA (?), so they only use RMA to get their $. True? Anyway, while I'm waiting for the RMA smoke to clear, should I start working on Sears too? My main objective is to delete both RMA and Sears from my CR. I am willing to settle to achieve this. RMA has listed inaccurate information, so that's at least 1 violation, plus possible other infractions. Does anybody have any suggestion on what to do with Sears in the meantime, and also as important, what NOT to do in the meantime? I can't blow this -- buying my 1st house this summer. (I owe the OC 2400, and RMA has the tally up to 3000 now. DOLA 98, so I can't wait for it to fall off my CR.) Thanks!
