Does anyone have the name of a lawyer who can help, or a general direction to get someone to look over this for me? <b>Hell, I would pay someone on this board to get it together for me! </b>That is how desperate I am. This 4 month issue with this company is making me really depressed, enough to where I am going to see a doctor next week (I know,boo hoo, it's all been said before here, but to me it's all new and it's affecting my life in a big way). I didn't realize credit repair could be emotionally devastating but it wakes me up in the middle of the night and occupies my thoughts all of the time how this one person at this company is so ignorant and has screwed me over again and again over something that was so simple to correct to begin with. Same ol' same ol' post, but I really need some help finding a lawyer who specializes in credit disputes. I have many violations being commited by a company but I need help with what the violation codes are so I can begin the process of filing a complaint to the AG and suing in Small Claims Court. I don't need a lawyer to go to court, just someone who will take my $$ and help me get there. I can't seem to gather the info from this board, unfortunately. I would need some one on one help.
Problem is there are less than 200 attornies across the nation who specialize, and who are good, at this type of law practice. MANY will file suits for you EVEN if they do not live in your state. -We can see you may have been "violated", but give us a break down of "what the problem is?"
I more than willing to contact any lawyer firm, I just don't know who. Here is the problem... A debt for some furniture I bought was "reaffirmed" in bankruptcy. 6 months later and after finding this website, I checked my credit reports and noticed this account was shown as BK and not reaffirmed, no payments reported, etc. I disputed with all 3 credit bureaus as reaffirmed and luckily, all 3 were then changed from BK status to reaffirmed. However since my first dispute, payments were reported for one month only though, November. DOLA was pre-BK, no balance shown, no mention of how much my monthly payment is or what the last payment amount was that I made (but they only reported one month anyhow). But then I noticed after the first round of disputes was over that on Equifax, that account was shown twice under two different account #'s (same creditor). I disputed as duplicate 4 different times, it came back verified as accurate every time. So I disputed directly with person in Iowa who reports the account to the CRA's and she says she can't remove the duplicate that says "BK" because it will remove the the correct one that says "reaffirmed", but she does acknowledge it is a duplicate. I call Equifax and tell them the problem. They said have the creditor write me a statement on their letterhead stating it is a duplicate and it will be removed. Yeah, problem solved! Nope. The lady in Iowa says she has never heard of doing such a thing. I call back and ask to speak to her manager and her manager refers me to the company's "credit dispute center." I fax in all documentation about the account and how it is a duplicate, and mention the verbal acknowlegement from collections dept. I get a letter in the mail about 10 days later stating "We believe this account is being reported accurately. Thank you for doing business with us." I redispute with more info and I get the exact same letter from the exact same person. I checked my fico scores the other night to see if this duplicate is really hurting me. I find out the account is now being shown as delinquent and 120 past due. I have never missed a payment and I pay double every month. Then I check all three credit reports and oh my God, the account is back in bankruptcy status again, but also states "paid or paying as agreed" but 120 days past due! I will say that I do have a mortgage that was included in my BK that was changed to reaffirmed because I asked if they would do this for me, and they did! That account is not in negative standing whatsoever on my reports, so having reaffirmed vs. bankruptcy DOES make a big difference on your credit reports. All I want is for the account to be shown as reaffirmed, payments reported, and not shown as a duplicate. I don't know why this is so damn hard for them to do. I am back where I started four months ago and I am just sick to my stomach. I want to send them an intent to sue and write down the violations. It is definitely killing my fico score, that is obvious and I can prove it. I think they are violating bankrutpcy laws by reporting as a bankruptcy when it was reaffirmed but I can't find bankrutpcy laws or reaffirmation laws on the Internet. I think the emotional distress is the worst of all but I don't think there is a violation code for that one. This is where I am hoping a lawyer will help me. I just want to hand over my notebook with all of the correspondence and ask them to please fix it. I wish I knew what the hell to do!! In 4 months, I haven't figured it out.
Well Snickers, Sorry you're having such a hard time. The most important thing we need to do first is figure out why this is driving you so crazy. Are you in a hurry to fix this, or do you have some time yet? When you filed BK you had a lawyer, I'm sure. Have you asked him/her? what to do? See if you can talk to a cpl lawyers in your area who may advise you. The most important thing to tell them is that the FDCPA & FCRA have SEPARATE provisions to allow for the collection of atty. fees to be paid by your adversary, should you prevail. Many of em don't know that but will perk when they hear it. lol In the meantime, chill out Snickers. You'll get through it. .

I know, I do need to quit worrying so much. I have about 9 months to go before I sell my condo and would like to buy a house. My frustration is out of 4 months of numerous phone calls, faxes and letters and all I am is back to square 0. The problem seems so easy to correct. The only creditor that pulled my report was this same creditor I reaffirmed with and I'm not sure of the exact date but it was the same month/year I filed. Butch, I called my lawyer yesterday and left him a voicemail about my situation. I'll give him another buzz this afternoon if I don't hear from him. I am not a confrontational person and I don't do well with threatening lawyers and court. I just keep believing the person who reads my fax, letter, or hears my voicemail is going to think I'm just this nice person who they should help. Hey, my BK lawyer just returned my call! He said I have a clear-cut FCRA claim. He said I can't go to Small Claims Court becuase it is a Federal violation. He gave me a number of a lawyer in Seattle who could possibly help, but said there aren't a lot out there. And Butch, he said the "other side" will have to pay for it! YAHOO!
