I got a judgment against me - again. This time it is totally my fault. I mailed the DV letter 1st mail without any CoM or CMRRR. Stupid me! (I lumped it in with other mailings without checking first!) Anyway, it was entered against me on 12/7, the letter was dated 12/18 and I just got it regular mail yesterday 12/23. I plan on pulling all my money out of the bank because my rent check has cleared already but I'm trying to remember the correct steps to take to remove the judgment. I haven't received any information subpoenas so I don't know if they will find my one bank account (which is in the area) and since I haven't applied for any credit using my current job, I guess the only way for them to know that I'm working is direct deposit. I'm thinking about closing my account and opening an internet banking account. Is this the correct course of action? Also, I'm going to court on Tuesday, 12/27 to see if I can get a court date to vacate the judgment because I was only contacted twice - once in August and again in October with a summons by mail with no index number so I thought it was bogus. I'm not even sure if this debt is even mine, even though if it is, it might be past SOL (NYS 6 years). Any thoughts or opinions on what next steps to take? Any help would be greatly appreciated!
bump Another development. When I went on my state's court website to search the information on the judgment the index number was not found. I know that I inputted the correct number because I put in an old case number and that came up. So what does that mean? The default judgment was entered on 12/7 so why wouldn't it be in the court's system by now. Also I noticed that I have an account representative at the top of the info subpoena. I didn't have a rep the previous time I got a judgment against me. Is that a normal thing to get a account rep assigned to me? Is it normal for the CA not to inform me what bank that they are requesting seizure for? Previously, I was notified that my Chase account would be seized. Anyone that can give me info, PLEASE do!
