Seeking feedback on letter

    I have been working to repair DH's credit reports. He has a tradeline from Providian as paid/account charged off; $131 written off. I disputed it with the CRA as "paid before charge off," but it came back as remains.

    Long story short, my DH had problems with his Providian account and they have been a pain to work with (to put it very politely).

    The letter below explains. I'm still new at all of this and wondering if this letter would help our case? Do you think the CRA would actually update his account based on this letter? Any feedback is greatly appreciated.


    Dear sir or madam:

    Re: social security number xxx-xx-xxxx

    I am writing to dispute an item appearing on my credit report. Providian Financial is reporting that my account (account number xxxx-xxxx-xxxx-xxxx) was charged off with $131 written off.
    This is not accurate information. The account was closed in good standing and with a $0.00 balance. I ask that you update my report to reflect this information.

    I have been trying to resolve this dispute with Providian for over two years now. As they have remained uncooperative, I have brought this matter to the attention of both the Better Business Bureau and the San Francisco District Attorneyâ??s Office. Please see the attached copies of letters of contact with them for reference. {side note: I do not actually have any letters from the BBB or DA; only letters to them}

    This account was opened in June 2000. In early September 2000, I relocated from Boston, MA, to XXX, VA. As a result, I did not receive a bill from Providian for the month of September 2000. After updating Providian with my new address, I received a notice from them on September 29, 2000 that they were closing my account â??due to its delinquent status,â? although the account was in actuality less than 30 days overdue. On October 7, 2000, I wrote a check to Providian, paying off the full amount due.

    Although Providian had closed my account, I continued to receive monthly charges on this same Providian account for Earthink internet services. I called Providian on the phone several times to resolve the matter (to stop any future charges) and paid over the phone to ensure that all charges were taken care of, that my account was completely closed and that no more charges would occur. They accepted my payment, but continued to allow charges onto my still closed account and charged me late fees in addition. I tried repeatedly to discuss this issue with them, but they remained uncooperative.

    I have spent hours and hours and a great deal of energy trying to resolve this issue with them without much success. I ask that you please hear my case and update my credit report to reflect closed in good standing.

    From a newbie stand point this sounds like a goodwill request. You only have letters to the BBB and DA which really does nothing for your case. Have you tried sending a dispute to the OC and trying to trip them up with FCRA violations.
    I really dont think you have enough solid evidence for the CRA to delete. This is just my opinion and remember I am a newbie.

    I agree with Leo. If you want to send it to Providian, that is fine. Do not send it to the cra's because
    1) they don't care and
    2) you are admitting way too much and it will never get deleted that way.

    You need to send an intent to sue letter to Providian. Advise them again, that they are reporting inaccurate info and you want it cleared up within the next 10 days. You have already given them 2 years and if they really are reporting incorrect info, they are in violation of the FCRA. Tell them they are in violation and your atty has advised you to pursue this legally if within 10 days they do not correct their errors.

    Lastly, if you sent letters/complaints to the BBB and atty general, why haven't you received any responses?

    Thanks for your replies. I think I will go ahead and try the intent to sue letter. Admittedly, I'm a little nervous - what if they call my bluff? Then I actually go through and attempt to sue?

    The atty general did actually respond to DH, but unfortunately it was through a phone call. They never sent him anything in writing. They did tell him that they were very involved with Providian because the BBB was so overwhelmed with a large numer of complaints against Providian (so, as a warning, avoid Providian at all costs, we are not the only victims here.)

    Wish me luck. If anything, I want it removed because I hate Providian so much.
