since I last did them back in 2008. The lawyers want you to provide all the info, including the credit card number! Who remembers when they received a credit card? Do you have 20 or 30 days to respond? These are dated 12/20 and my mother gave them to me today. She has no idea what accounts are referenced. I swear I went to court with her on one of these and the lawyer gave her a pass. Of course, whether she can find this or not is another story. The other I will claim admissions for the choice of law (since it's Cap1 and Virginia's 3 year SOL applies (I think)). What's the proper way to answer the production of documents questions? I'm sure she has nothing filed pertaining to this. Thanks again
Re: Seems like Interrogatories, Production, and Admissions has gotten harder to answe Hi Phantom, As best I can tell defendants have 30-45 days to respond to interrogatories from the date of request; I'd stick w/in 30 to be sure. Also, it doesn't describe which accounts are referenced?
Re: Seems like Interrogatories, Production, and Admissions has gotten harder to answe Nope. They sent two sets of the same interrogatories to her, the only thing different is their internal code and the amount. I am answering them assuming the smaller demand is the Cap1 with the smaller credit line. Unfortunately, I've done some more research and found a case heard here in Rhode Island claiming Virginia's SOL and the debtor lost. Unlike Florida, RI thinks these suits are procedural rather than substantive. So that defense goes out the window. I might just have to persuade her to do a chapter 7. Thanks
