They updated my report by reaging the dates and updated the status to 'checked' which dropped my score by 45 points =\ I also asked them for validation... Now what? Thanks again for all your help! Parul
If they did not respond to your validation, updating the CRA is a violation. They are not allowed to do that unless and until they provide you proof that you owe the debt. 30 days after sending the validation, send the Estoppel letter and demand they delete the listing, provide you the proof you requested, or you will file a lawsuit for violations of the FDCPA, and FCRA on XYZ date. Keep all your CRRR green cards, copies of everything sent, and copies of your reports showing the updated information for evidence if you have to go to court. Good Luck -Peace, Dave
I actually faxed the CA - i have the transmission success slip. Thank you for responding - I will send them another fax to get them to send me validation. Or should I be using CRRRs only? Thanks! Parul
I recommend BOTH. If I were going in front of a judge I would want to provide him/her with AMPLE evidence that I tried to contact the CA and have them provide my legally allowable information that the FDCPA and FCRA provide me. By having FAX success slips, and CRRR green cards, you would be able to say "Your honor, they blatantly disregarded their obligation, and that is what FORCED me to take this up with the courts and why we are all here today". That is, assuming you get to court....they most likely will settle without going to court, especially for smaller debts...it just isn't worth it. -Peace, Dave
