Serving Corporation through SOS?

    I have run into some problems suing RMA. Their principal place of business is in Gwinnett County, GA, but the registered agent is listed in Cobb County, GA. The nice folks at Gwinnett County Courthouse said their sheriff wouldn't serve a summons to Cobb County. I called a process serve and he said it was a big deal to serve a corporation in another county. He said you had to go before the judge. He recommended I serve them through the secretary of state. Has anyone ever heard of this? Sounds feasible to me. Thoughts?

    In many states, the Secretary of State will serve registered agents for corporations with suits. I would take the process server's advice and have RMA served through the Secretary of State.

    Check the Georgia rules of civil procedure (or the equivalent title) and find the rule on service of process. It's best to know this yourself rather than relying on the process server.

    Having worked in the legal dept. of a corporation, I was under very strict orders to accept only personal service. The corporation you want to sue may be just as technical about it.
