I'm getting ready to sue Equifax for FCRA violations. I've finished writing out my complaint & have downloaded the paperwork to file. I have read here that it is a good idea to send the settlement letter (drop lawsuit in exchange for deletion) along with the lawsuit being served. I'm serving the registered agent with the lawsuit....is this who I send the settlement letter to as well? Or...is it better to send the settlement (referencing the case number) to the legal department, or either an Equifax manager? Please advise the best approach where I can resolve this the most expeditiously. Thanks in advance!
File the suit first. You can always setttle on the courthouse steps. I wound never send a settlement letter with an ITS or a summons - make sthe other side feel you think your case is weak. Just sere the Registered Agent and let THEM contact YOU if they are interested ina settlement.
