"Settlement" Letter

    Hi all. Over the weekend my mom got one of those collection agency settlement letters for per providian card. Well when I was reading I had to laugh out loud.

    It is the standard - you can pay this much and save __% if you pay by [a certain time]

    Basically it says.

    debt is $6,381.80
    you pay $0.00

    you will owe $0.00 and debt will be settled.

    I read the letter at least three times to make sure I was reading it right, but it is telling her to pay nothing, and her debt will be nothing. I told her to send them a money order for $.01 to make the account 'settled'

    I'm pretty sure this was an error on their part but if she actually acknowledges the correspondence by paying something will that be enough leverage for her to hold when they come back and say we scred up, you still owe us something?

    Just wondering.

    Hmmmm why can't I be so lucky?

    Curious - was it signed? Could be considered a bonafide offer. I would send a check for $0.00 just to have met the terms correctly :)

    Somebody once told me to have a valid contract you have to have an offer (pay 0.00) and acceptance (send that $0 check)! If you sent them a check for $.01, then you have changed the terms of their offer, and they would be free to alter the offer.

    LOL - don't go on my word here, but it could be fun!!!!!!!

    Was it fom Midland Credit Management? I got one from them on an old Providian acct offering to settle for 50%. It's past the SOL for collections so I'm going to send a validation letter. If they pull, I'll have them on non PP as well as re-aging, which they've already done.

    I don't remember who it was from. I'm going to have to call her and ask her. Well I wonder if you can get a $0.00 money order. She doesn't have checks or a credit card so that would be what she would need to send them.

    Be careful. All Providian has to do is yell harmless error. Some courts would agree with them.

    Just send any old check for 0 even if it's from a closed account from anywhere .
