Hi all! I'm hoping someone can help me with finding a sample settlement letter for someone who has recently passed away. My mother in law passed away at the beginning of the year and we are about to settle the estate. The debts that she owed when she passed will be paid once her house is sold. I do not want to pay the full amount she owed and would like to negotiate with her creditors. What I have found so far is written for people who would like deletions and other stipulations. I just want them to take a portion of what is owed...her credit report doesn't matter now. Does anyone have any ideas? Thanks so much! Flagirl
Who are the creditors? If it is doctors and hospitals and nursing home and they are local, it'll be tough. When you probate the will, it becomes a public record and anyone can look at the estate and estimate its worth. It'll be easier if the debts are to credit card companies.
Are you in Florida? If so, there is the homestead exemption that shields her house. I think the house will pass to the heirs automatically upon death, and is not subject to the claims of creditors. You may not have to pay at all. You need to see an attorney.
