I have a charged off account with sears that was either placed or bought by sherman. I asked for validation but recieved a reply back from an attornry that they will proceed to court within the next 45 days. Before i found this sight i had no knowledge of their tricks and tatics,so back in 01 i had agreed to take care of the debt , along came a divorce and needless to say that when i started to clean up my credit report and asked sherman to validate they want to proceed to court.Well i have read lots of posts and took nana"s advice about checking out the liciences of the collection agency. They are not bonded in texas which is a requirement so i have a cerfitcate of this coming asap. I"m 99.9 % positive they don"t have a licensie in my state (tennessee).Any thoughts on what to do next to make them dispear forever. Thanks
If you live in Tennesse, what does not being bonded in TX have to do with it? Am I missing something?
If you live in TN, you need to check out whether your state requires them to be licensed, bonded, etc. And whether they are licensed, bonded, etc. in your state. If you saw in a post someone saying that they weren't bonded in their state (TX), that only means that for that consumer, and any other consumers in their state, they have the CA for violating the law, but that is only for people who are in their own state, since that would be violating a state law regarding collection practices. You can usually go to your state government web site and look for "Secretary of State"; in PA it's "Department of State", so it could be any "of State" department, they will probably have a form where you can look up company information. I just found PA's form last night. http://www.carreonandassociates.com/statute.htm#Tennessee This is the web site that I typically check SOL and other information on, since it also lists the license and bonding information for CAs (TN requires licensing & bonding)
The post stated that you check for both states. Tennessee does recquire both liscenses and bonded. Thanks
