Should I Be Suing Bank of America?

    Hi all. I haven't posted in forever but as usual, I have two questions. In 1992, I opened an account with BOA. I am guilty of some return checks and then, someone stole my check book. I filed a police report and the account was closed. They reported it to Check systems, of course. Here we are, in 2002, and I get a call from Arrow Financial stating that I owe them for an overdraft protection account. They explained this account as being one with an actual credit line to provide over draft protection against my checking account. I had no such account. They call every single day and I have told them I never had over draft protection and they hang up abruptly but call the next day. Can they be calling me 10 years after the fact and should they call me since I never had an over draft account? Also, I have tendonitis qand all this typing and searching is killing me. Junum. Is this a good thing or not? I can't type the letters I need to dispute and I need one derog deleted if possible. It's a Fingerhut account. Thanks in advance. Oh, and I guess I should change my signature line since the A's are doing quite well without Jason :)

    If all of this took place in 1992 it is past the SOL. Tell them to shove it your not paying S**T.

    Use the validation letter and then see if they keep calling you or sending letters. If they still call... get a tape recorder... tape the calls... get the phone company records showing their calls... then sue them for violating the fdcpa

    teach them a lesson... but until you send the validation letter cert rr then they'll just keep calling.

    In lieu of that... you could send a cease and desist but I love validation letters b/c it sets them up to violate your rights via the fdcpa and fcra :)

    have someone type it for you (cut and paste from this board). there are some nice examples of letters here ;)
