I negotiated a settlement for deletion and they put it wrotting. In their letter they noted that it may take the credit bureaus a few weeks to update. I took the offer. Now, I am wondering if I should dispute the trade lines again. What do you guys think? thanks a bunch,
Wouldn't hurt to dispute the tradeline. All things being equal it just won't be verified, and then just deleted.
Hey mindcrime, I was wondering how some of the other folks get into these issues with cras that won't delete. And end up having to go to court. In your opinion, should I just dispute as not mine and not mention any settlements?
You could dispute as 'not mine'. See, your situation is slightly different from what I've done before. I've never settled with a CA, they've always either just deleted, walked away, or sent a UDF to the CRA directing deletion, in none of my cases did I actually pay the CA, because with all the violations I tracked them on, they would be owing me money. How is the settlement letter setup? Does it make reference that you in no way admit that this is/was your account? If so, then it should be safe to fax that letter to the CRA's (instead of disputing). I know what you mean when a CRA just won't delete something. I know others on the board have been through it.
This was actually an OC. I did catch them on violations but I kind of wanted to stay out of court with this. They wrote that they would accept 25% as "a settlement in full" and also they agree to delete upon payment.
I tend to believe OC's are more true to their word than any CA would be (regardless that you have it in writing). You might just wait it out for a few weeks. If they settled for 25% with deletion, they can't be all that bad. What you might want to do, is call the OC, and ask them to fax you a copy of the UDF they are sending to the CRA. A UDF won't make any mention to a settlement, it is a straight delete this tradeline bit. If you can get a hold of the UDF, I'd fax that to the CRA's, today. Otherwise, hang loose.

Have question, what if you went around the CA and paid the OC and the OC provided a deletion letter and the CA and the CRA both won't delete? Since the OC is not holding the account they can not delete the trade line. Would it be better for me to go back to the OC and see if they can pull the account out of the CA hands and then try to delete the line? The OC is a Utility.
