should I dispute?

    Some of you have read my posts about Simm Assoc. collecting on a CCB charge-off late last year. I have requested validation and they have called twice since receiving validation stating they can't answer the questions I sent until they talk to me on the phone. I HAVE NOT received the green card back yet. I know I've probably set myself up good, but should I dispute it with the Credit Bureaus, or am I just hurting myself if I do? Patti

    Well they obviously recieved the validation letter, right? Have you tried confirming that at USPS.com?

    They have no reason to be calling you to talk to you before validating. They are probably going to ask stupid questions to make their job easier...NOT!

    If you are sure they received it, now is the time to dispute.

    jlynn, I did check it just now and it was received on the 19th. How should I state my dispute?

    do you think they're gonna try to sue me over this one? Or have I already got violations for the phone calls?

    Didn't we decide they have no legal right to collect from you in NM because they weren't licensed?

    And they still can't sue you until they validate.

    Others may disagree, but I think you may have to take one phone call from them to see if they pursue "continued collection activity".

    yes, but I figure the jerks will just send it to someone in NM.

    I would go ahead and dispute it. They cannot verify the info to the cra without validating. If they verify with cra's and they havent made the attempt to validate the debt with you, then deny this is yours. State that you have requested validation, sent proof of receipt and say the ca has not responded because they cannot prove this is yours.

    It didnt sound like it, but are you past sol?

    no, charged off in August, 02. They aren't reporting, only OC....CCB

    Oh geez, I thought the CA was reporting. You can dispute the OC tradeline, but I don't believe they are bound by your actions with the CA, so they may verify, and that wouldn't be a violation.

    exactly!! That is why I didn't think I ought to dispute. I'm sure they will validate, since it is still so new.

    Well, I haven't done anything with my two unpaid chargeoffs. They are both with CA's. I'm saving the not mine dispute for the right opportunity. (They both occurred less than a year ago)

    Just trying to hold the CA's at bay so I don't have two derogs for one account.

    How much are they trying to collect?
    How much do they owe you for violations?
