Husband is in a ch 13, our mortgage is in the ch 13. The mortgage company has not updated the bureau since Nov 03. Each time I disputed 2 of the bureaus claim they verified that the information is accurate. It shows foreclosure started. The problem is each month I dispute they change the date example Forclosure started Apr 05 etc. The mortgage company said they do not update the bureau when the account is in BK. That being said do I have a case against the bureaus???
which CRA? how exactly did you dispute it? IMO it may be right if they are verifying with the OC that foreclosure was started 11/03. And since it is updating each time i am assuming this is experian?
get a letter from the mtg company stating what you mentioned in your post. Mail or fax a copy to the bureau(s). If you fax, make sure you run a fax transmission transaction sheet to keep for your records to prove it was received. I would also mail a copy, return receipt requested, of course. This should do it for you. Good luck.
The letter is on it's way, but once I have it should I expect/demand a deletion? Especially since the letter will indicate that they (the mortgage company) have not updated the information since Nov 03, so even though I have disputed for over a year and they just kept changing the date, will they delete? The other thing if the letter indicates that the account is involved in a chapter 13 can the CRA report that on my report even though I did not file a ch 13. What else could the CRA do?
This did not work. They just changed the date again. Now it looks like foreclosure proceedings have started as of this May!! ANY IDEAS. Should I just file a small claim?? Help me out here.
