I disputed a late 10/2000 on both mine and my husbands credit reports for our mortgage. Not only did it come back verified on both of our reports, it is also showing that we are now currently late with TU and EQ. I called the mortgage company and explained to them that the CRAâ??s are reporting it as currently late. They said it couldnâ??t be, because it is not late. I said exactly, so why are they reporting it late. He did not know, but he would send info to them, which he said should take about two weeks. In the mean time I disputed it again with the both CRAâ??s. About a month later, I received a letter from my mortgage company that they are unable to comply with my request to â??alter my credit reportâ??. The next day I receive a letter from TU saying my creditor previously verified as accurate the items below listed (mortgage company) Therefore, under the FCRA, we consider this dispute frivolous. I then make a call to my mortgage company again; asking them why is this still reporting as currently late for the last two months. She does not know, and repeats to me again that I was only late one time back in 10/2002. I asked her to fax me a letter stating such, signed and on a company letterhead. Later I received two letters, one for each month I was not late. All each letter states is â??your payment was received on such and such date and has been credited to your account accordinglyâ??. The next payment is due on such and such date. And, it is not signed. So, now I have these two letters, with the cover letter from my mortgage company. Also, I printed a page directly from the mortgage companyâ??s website where I can login and see my history. I have the payment history from January, clearing showing I was not late the last two months. Would it be better to call them, or fax them a demand letter of some kind. Bottom line: TU is refusing to investigate, and received a letter from mortgage company refusing to correct. Note: This is still under investigation with Equifax. I am sure when the 30 days are up, I will have the same problem with them. Thanks for any help it will be most appreciated.
You couldn't have possible been late in 10/2002. LOL Anyway, my suggestion and probably the easiest way to deal with this, is to once again call the lender. Tell them you need a letter stating you have not been late. Not a letter stating they received your most recent payment. Once you get that, fax it to the cra's and they should update your file within a few days.
LOL. I meant 10/2000, but who knows, that's what our CR reports may show next month........... Anyway, when I talked to my lender, that is exactly what I asked for, a letter stating we have not been late and all they would send is what I described above. Which actually seems like a form letter.
Hmmm~ this is defintely proof that disputing an otherwise clean tradeline will sometimes garner you other problems. I'd have to say that disputing it with the CRA was the first mistake. Your first dispute should have been with the lender. If you were really late, a goodwill letter might have been a good idea. If you weren't really late, then a full fledged dispute would have been good. But now it just sounds like there are too many fingers in the mortgage pie. Take all of your evidence and get the fraudulent current lates off. Then wait a little bit after the dust settles a bit and try to goodwill that one late. But I totally have to agree with LKH. Try to get the letter stating you have NEVER been late. That will be your best course of action.
Thanks for the replies. I just finished tying a letter for TU, and I am going to call my lender again in the AM. After reading the letters from them, it only shows when I paid. How is the CRA supposed to know what the due date was in the first place. Thanks again
Letter from Lender Well, I finally received a letter from my lender stating that they requested a change to our credit record, to delete the derogatory statues for the dates that are wrong. They sent this to all 4 CRAâ??s. Should I also send TU the letter I received today? Will this help change it faster? I heard it could still take several weeks. If I do send it to do them, what should I write in my letter? Perhaps something like: This is a follow up to the request you received from my mortgage company xxxxxxxxx on September 24, 2002. Please fix the following asap. Or if somebody else has something better to say, I would love to hear it. I am not very good with words, and from reading this board for many months now, I realize what one writes is very important. Thank you for your help and your replies, it is really appreciated. Sandy I
