I have a CO Citibank account w/ a DOLA of 7/98. I am in OH and the SOL is 4 yrs. I haven't received anything from CA since July '03. The CA is not showing on CR, only OC. I want to pre-qualify for a mortgage, but I know that they will want me to pay off or settle the debt. I have a few others like this on my CRs. I've worked really hard since Oct to get a total of 29 deletions. Any suggestions as to what I should do? Should I settle them since they are SOL? tmcnc EXP 522 (12/03) EFX 554 (12/03) TU 469 (12/03)
Suggest a CMRR estoppel letter basically saying you last contact was 7/98, you dispute liability and amount, and that OC should contact you if they believe their claim on account xxx xxx xxxx xxxx is not time-barred by the applicable SOL. See what comes back, and deal with it then.
And you have a little time..I know those are December scores but I would like to see them a little higher for a mortgage.
They haven't continued collection efforts since July 2003. Wouldn't I be better to send for validation first and if they send me something back about collecting a debt, then I'll send estoppel. Also I just noticed on my EXF report, they have my DOLA as 7/00 and the credit limit at $5600! My credit limit was $500! Have they violated something? That is re-aging and wrong amount owed right? It's not on EXP, but on TU the DOLA is 7/98
If you've got the SOL goods on 'em, the estoppel would be faster. And if they think you don't ... they'll cut to the chase on that issue so you can meet it. It could of course be combined with a DV/VOD letter.
