I am learninng alot from all of you and would like an opinion regarding a CA.

I sent a do not call letter to the CA via fax a year ago. (via fax and no reciept)

They left us alone but after three months started calling again.

I wrote a letter asking for an explanation and they never responded (big surprise)

They then sent a letter saying they had recieved permission from original creditors to begin legal action on seven accounts. only two accounts are within the SOL and total under $300.00. three accounts have been paid minus the CA interest which only is about $1.23 for all three accounts, 2 accounts listed show a zero balance. I called original creditors and none knew of giving any permission.

I wrote a letter back after six months informing them of the violations of the FDCPA (2 calls after the dont' contact notice and 1 violation for threatening legal action when they had no intention of doing so.)

    They never responded.

Three weeks later I recieve dunning letter (at this point, I have found this site and now know my rights)
I respond with a req. for validation letter and creditor disclosure statement and clearly list the account I want validated in my letter via certifed mail and fax.

They respond with the words "wich of the seven accounts would you like information on" (their spelling not mine) scrawled across my creditor disclosure statement.

I send them another validation request but this time since they offered I demand validation on all seven accounts. I also inform them that thier last response did not include the required "this communication is from a debt collector, any information obtained will be ..." and that they have again violated the FDCPA.

My question is am I missing something? This company cannot be this stupid. Can I sue them at this point or should I let them keep racking up the violations? Should I look at this as a retirement account? OR Am I doing something wrong?

How about a little extra spending money? But you need the proof that they received your correspondence. I would think that replying to your questions in another letter would be pretty good proof. Just make sure all your ducks are in a row, Follow up with the appropriate demand letters, and keep all the letters and the little green receipts from the post office.
