Should I sue today?

    Here are the facts:

    Due to a life threatening illness, 3 month hospitalization, near death and my wife losing her job at the same time, we stopped paying all bills in April 1997. Filed BK13 in October 1998.

    I have managed to dispute and/or sue all derogs off my CRA files except for Discover. The month of default was April 1997. Take that and add 7 years means (IMHO) the debt should come off my CRA file at the end of April 2004. It has not happened.

    In January 2004 I sent letters to TU detailing why this TL should come off after April 2004. I got no response.

    On May 29, 2004 I faxed a letter to TU advising them that this TL would become ancient under FCRA on April 30, 2004. I got no response.

    Today I verified that it is still there. Should I sue?

    Why don't you just call and ask them why it hasn't been deleted?

    Their CSR's can't see my file because it's in "special handling" (may have something to do with the fact that I am already suing them over one violation of FCRA). CSR's will send a message to Special Handling, but Special Handling won't return any calls, so I don't have a number to call.

    The only way to get their attention it seems is with a Summons.

    Well, I was just about to sue and figured I'd try one more time. On TU's web site the only phone number they post to HQ is to Public Relations. I figured "hey, I'm the public and they ain't relating to me very well".

    I called and got transferred to someone who just removed it - right then and there. I got his name and direct phone number. Anyone else having problems with TU?

    What about the 180 days after delinquency for the starting of the reporting period? I've seen a lot of discussion in the past about this. Is it 7 years + 180 days or just 7 years?

    180 days? I don't need no stinkin' 180 days.
