Should I wait for proof?

    Hi everybody,

    Need a little advice. I have sent two validation letters to an original creditor. I received correspondence from them stating that they will investigate my claim and get back to me within 10 days. They also stated that, if the investigation took more than the 10 days, they would notify me. Well, the 10 days came and went with no word from these people. I faxed a letter to the company telling them this and that it was obvious they could not prove this debt and that it should be immediately removed from my files. Received another letter last week "claiming" that they sent me a followup letter explaining that the investigation would be complete by May 5, 2002. I started the validation process at the end of January, 2002. Should I give them this time to come up with something? I feel that I shouldn't because they have consistantly validated everytime with the credit bureaus and that, if they didn't have the proof on hand, they shouldn't have continued to validate. But, if we were to go to court, could they argue that they are trying to verify and just need more time?

    You are asking the age old question - do I wait longer, do I send another letter, do I pull all my hair out or do I subpena them for court.

    I'm in the same situation here, I've sent my second validation letter to USA FUNDS (school loans) It's been over 60 days now and I still have absolutely no proof from them (copy of signed notes) .....But they still happily update my reports each month.

    The only advise I can give you is to send them another more threatning (lawsuit) letter. I'm hoping someone will jump in here and offer both of us some more valuable advice.

    I hope so too, Sal. Everything I've read is to do everything possible first and that suing is a last resort. So what happens if they come back on May 5 and say that they need more time?

    From what I've learned on this board and from other's is that you give them about 90 days (leaving room for the "I needed more time BS") then you have them served.

    How can they possibly tell a judge with a straight face "oh we needed more then 90 days to find the proof this was her account"
