I decided to post again, didn't get much response to earlier post. I want to send this CA a letter in response to their letter I received today. They are requesting that I send my signature and SSN to provide validation I have requested several times now. I read a post from a few days ago, where someone was asked this same thing, although there's was a paid collection. I feel my insurance has probably already paid this, but if they won't send proof of the debt, I don't even know which Doctor it is for! They must have my SSN or the debt wouldn't have been placed by them on my credit file. Who else would request validation but me?
WTF! They have your SSN etc. if they posted this to your credit report. IF they haven't, if you send them this information then they can. If someone is saying you owe the debt, then they should have proof you do, Not you sending them the proof. Screw them.
Uhh...yeah! Gotta go with Kiyi on this one! They are straight trippin! There is NO WAY I'd send them my signature and my SSN. I'd send a nice letter saying, "Hell no and if you don't have this info, I think the FTC would find it very interesting to say the least!". Let them eat THAT!
Oh they definetly have reported the debt, they even reported the same account twice with adding a couple zero's to the number! They acknowledge that it is a duplicate listing, and say I need to dispute this with the CRA's!
I think I would simply ignore their ridiculous attempt to change the subject and move on to your estoppel letter. Keep the pressure on them. I wouldn't be so paranoid about signing things, BTW- I would have signed the letter in the first place- but that's me.
I don't sign crap cause the one time I did, they photoedited to another piece of paper. I kept copies of my letters, praise god, I went to court when they sued me. They print this out with an ink jet printer. Judge said, Your signature is RIGHT here!...I looked at it. licked my finger and its smeared, I said, Its a copy of my signature from this real one signature that I sent with my letter. He threw it out of court.
Well what I might do is sign my name, but a little differently than I do normally. I'm torn here. I'm going to provide the last 4 digits in my SSN, I know they have it because they reported the debt. I hate to be so "paranoid", but I've read so many bad experiences with CA's.
WHY? Why do you feel you need to do this? Why are you making it sooo much harder on yourself. If they can't do it, then screw them. Send an Estoppel. tell them to delete the account off your credit reports NOW since they can't produce any information regarding the account or you will sue them.
Tell them it's their obligation to fix their mistakes. They should update the bureau. Quote section 623 to them ... (2) Duty to correct and update information. A person who (A) regularly and in the ordinary course of business furnishes information to one or more consumer reporting agencies about the person's transactions or experiences with any consumer; and (B) has furnished to a consumer reporting agency information that the person determines is not complete or accurate, shall promptly notify the consumer reporting agency of that determination and provide to the agency any corrections to that information, or any additional information, that is necessary to make the information provided by the person to the agency complete and accurate, and shall not thereafter furnish to the agency any of the information that remains not complete or accurate.
I made this mistake and you will feel foolish when they have your SS# and are verifying to all the CRA's because you gave it to them. I did that and not only do I feel like a total idiot, but I also am in deep doodoo with Experian. CBJ
Don't send them a damn thing. The burden of proof is on THEM - not you. They have to prove that this debt is actually yours - you do NOT have to prove that it isn't. Don't sent them ANYTHING - NOTHING!
Premeno, 3 Words! DONT DO IT! It is THEIR RESPONSIBILITY to know who YOU are. You, me and everyone else on this board knows who WE are. Nothing else matters. Sorry to shout, but this really P****S me off!
OK, I won't give them anything. They have already verified the debt with the CRA's. So thats what I will say in response, if they verified they must feel certain they can validate, if not they had better DELETE!
Do NOT send them jack. In fact, if you call the FTC tomorrow and tell them what is requested of you by the ca, they also will tell you that you have no obligation to send anything. They accuse, they must prove. Plain and simple.
